Hello All, Need your suggestions regarding CHC Immigration Refusal

Hello All,

I applied for PR to CHC (New Delhi )India in 2004through an agent . I have also authorized my agent to receive all the communication from CHC through form IMM5476 "use of representative"

Recently i saw "Decision made" in chc website. No communication was stated as received by the agent.
I informed the agent and he represented to chc saying neither him nor me received any communication from chc to make any decisions.

Infact I have shifted my residence twice in between and could not inform the latest address update neither to agent nor chc.

Later i informed my address update to chc and received CHC letter which says " Refusal because documents not submitted within 90 days & letters returned undelivered"

The question i have is since i have authorized an agent, why does chc send letter directly to me . What is the rule ?(Infact chc has sent some previous communications like file number etc through my agent earlier)

 How do i represent this with chc and get this refusal removed since i dont have problems to provide the documents they require.

On the application form imm0008e, field 14 is mailing address and field 15 is the residential address. Correspondence will be done to the mailing address. Check what you have filled.

Also, if you shift your residence, you must inform CHC asap, in writing. You may have to reapply because of this reason.

I hope your agent is giving you proper advice.

Thanks for your advice. I happen to see IMM008 and field 14 viz Mailing address shows Agents address.
As you said, CHC should have forewarded to Mailing address but agent claims not received any letter frfom CHC.

Field 15 is my Residential  address( old address)  .CHC has sent correspondence here and since no reply from my side, have sent refusal letter.( I have currently updated this address with  CHC)

Agent has informed CHC about not receiving any letter and awaiting CHC response.

What should be my response now ( atleast to ensure that chc refunds my processing fee). Also, What does Reapply mean!

1.  They are not going to refund your fee, they processed the application and refused it.  Remember CIC is not your mother, you or agent didn't inform them of the address changes, so they made their decision with the information that they had on file.
2.  You would have to re-apply for Immigration and qualify under the list of "38" occupations.
