''A Candidate must be currently working in the United States and possess a valid visa in one of the following temporary skilled worker visa categories: H1-B, H1-B1, H-1C, E-3 at the time the AINP makes a final decision on the application;''

The above was taken from Alberta website. Does the last sentence mean that the H1 has to be valid only till the nomination from Alberta is finalized or H1 has to be valid until we get the PR.

After getting the nomination, if the candidate returns to home country, can he still continue the federal application process till the PR ?

Those who applied after Feb 19;
H1-B has to be valid till your AINP nomination is issued. After you receive your nomination, your CIC application can be processed in your home country.

Those who applied before Feb 19;
H1-B needs to be valid at the time of AINP application (H1-B status does not need to be maintained after Alberta receives the application).

You mean those who send the package to AINP or for pre-assessment?
I sent my pre in Dec 18, but my package in march 2009, due of the bad service of mail forwarding.
I don't know which applies for me, the before Feb 19 or after.


Those who applied after Feb 19;
H1-B has to be valid till your AINP nomination is issued. After you receive your nomination, your CIC application can be processed in your home country.

I'm not 100% confident but I strongly believe that all applicants with old process (with pre-assessment) are considered as "applied BEFORE Feb 19."
