Hello all,

I am new to this Forum and would like to share with you all information about my process and also learn some more with each one experience.

Here is a little about my situation

Applied for the Alberta PNP in March 2010
Received file number in Octorber 2010

It has been over 18 months since I applied but have not heard anything from the agency since then. Does anyone share the same experience?

Thank you all......

Hi Alamgeer,

Thanks for your comment.

I contacted my Canadian lawyer 2 weeks ago and I was informed they are not processing the cases whose file number was filed in August & September. Therefore, our case should be coming very soon.

Best of luck!!!!!!

ANYBODY HAS SAME EXPERIENCE? PLEASE SHARE

Hello guys....I would like to share my experience until now am still floating but am hoping for positive results: Here is Story:
I got nominated for PNP of Alberta under H1 B. My nomination was approved last May 2010. My certificate of nomination expiration then was Septemebr 28, 2010.
my lawyer submitted all the complted application package to Buffalo last Ausgust 13, 2010.my application was postmarked by Buffalo Immigration as application receievd August 13, 2013 and marked documents complete. probably, they did not start proceesing my application not until October 4, 2010 and they send me a letter requesting to issue a new managers check for the check that they have receieved (Dated June 29, 2010) were valied only for 90 days so in other words they want us to issue a new check. Immediately on October 6, 2010, my lawyer sent them a new managers check which they received October 10, 2010. Since then , I have not heard from buffalo regarding my application, then May 17, 2011, I received a letter requesting to undergo medical Exam, which I did on June 15, 2011. After that I have not heard again from them then last Septemebr 22, 2011, my lawyer got an email informing that to expedite the process, the file was transfered to Los angeled branch for further processing.

Then October 12, 2011, my status in ECAS made a big changed after a long time, and it says like this:

We received your application for permanent residence on October 21, 2010.

We started processing your application on October 12, 2011.

       Medical results have been received.

A decision has been made on your application. The office will contact you concerning this decision.

I was puzzled the whole time for those update and has been waiting for PPR, then today my lawyer finally got an email saying that my application as refused due to my application was recieved after my nomination certificate expired last Septemebr 28, 2010.
They were absolutely wrong, The LA office did not check the history of the file when was the application was recieved by buffalo as post marked by the buffalo immigration that they received my application AUGUST 13, 2010
Now my lawyer wrote them   thru email stating steps by step what happened and attached all the post marked stamps from the buffalo consulate......am really hoping to get a psotive feedback due to the fact that their reason for refusal was not my fault by theirs due to their miscalculation of dates.
I wil keep you posted guys to the developments as am sure some may have experience same situation......Good Luck to all of us.

Hello Guys,
I got an email last Thursday that my application was refused due to the following reason:
According to the VO, my application was received last October 21, 2010, and my certificate of nomination for PNP program (I was an approved nominee for Alberta) expired last September 28, 2010.
And for this reason, they refused my application for PR due to my application was received after an expired certificate.  All other documentation was okay except for that reason stated for refusal.
My question to all of you is : CAN I FILE RECONSIDERATION TO REVERSE DECISION N THIS ON GROUNDS THAT THEY OVERLOOKED MY APPLICATION DATES?  Why am saying they over looked the dates is because here is the brief story of my application:
I got nominated for PNP last April 2010. My approval certificate was valid until September 28, 2010 and per PNP rule, the CIC of buffalo must receive the PR application before my expiration of certificate.
I submitted my complete documents to CIC buffalo last August 13, 2010 (I have a copy of the tracking receipts and a copy of the application postmarked by the CIC buffalo that the application was received last August 13, 2010) Included in the application was the application payment of 550.00 in cashier's check Dated June 21, 2010 and has validity of 90 days)
But because they did not cashed the check within 90 days, the check becomes a stale check ( why they waited long to cashed it...I DON'T KNOW.) for this reason, CIC buffalo sent me a letter last October 4, 2010 requesting to send new checks in replacement to the lapsed checks. No other things requested other than the checks. So I immediately send them a new one on October 10, 2010 sent by Fed EX.
Since then, I did not hear anything from buffalo, then May 17, 2011, I received a letter requesting me to undergo medical under DMP, which I did on June 15, 2011 and was received by Ottawa last June 27, 2011.
Then I have not heard anything again, and then Last September 22, 2011, I received an email stating that my file was transferred from buffalo to Los Angeles office to expedite the process.
Last October 12, 2011, My ECAS changed to decision made but no PPR so I waited for the letter  but after 3 weeks no letter came so I decided to send them email last October 27, 2011, then they responded last November 10, 2011 stating that they refuse my application due to my application was received after my certificate was expired.
MY QUESTION:
1.   How come the VO say my application was received in October 21, 2010 when my application was stamped by buffalo August 13, 2010?
2.   Is that our (applicant) fault if they did not cash the checks right away? Are we to be blame for that?
3.   If my certificate of Nomination was really expired, how come Buffalo did not say that when they asked a check replacement last October 4, 2010?
4.   Why let me undergo medical after 1 year if at the end my application will be refused?
I have all the documents from Buffalo...what do you think with my situation?
Do you think I have strong grounds to request for reconsideration? Is that considered an error on their part? What do I have to do now? Do I need a lawyer for this? PLEASE HELP

first, you need to defend your case for your own interest. it looks like you did all you should do and did well, except:

why you sent a check with only 90 days of validation? why you did not send a cash draft or money order with much longer valid time? but anyway, it is too late to say that. i hope you win your case.

most of the certified cheque/money order have 90 days validity. That is not your choice, and Buffalo knows that.

I got a certified check from Chase bank that does not have an expiration date.
