Thank you for your inquiry regarding the processing timeline of your Federal Skilled Worker application under the Ministerial Instructions 1.

The following information may be useful to you in explaining processing times.

Changes to immigration law in 2008 allow us to set, through ministerial instructions, the number and type of applications considered for processing each year, and the order in which these applications will be processed.

Under the first set of instructions Citizenship and Immigration (CIC) used our new authority under immigration law to control the type of applications received, but not the number. We learned that wasn't sufficient. With so much competition and interest in immigrating to Canada, applicants, and sometimes consultants, look for ways to fit applications into the eligibility criteria in effect at the time. Therefore, before we introduced a cap on the federal skilled worker program as part of the second set of ministerial instructions, the number of applications we received exceeded our ability to process them in a timely way.

Your application was submitted under the first set of instructions and unfortunately it will take longer to process federal skilled worker applications submitted under these instructions, those received between February 27, 2008 and June 25, 2010. During this time, the department received applications for more than 425,000 people, and 144,000 of these have not yet received a decision.

This number represents more than twice the number of projected admissions under the federal skilled worker program in 2011, so many of these applicants will have to wait two years or more to be processed.

The length of time it takes to finalize an application varies from one visa office to another since visa offices face different challenges operating in different countries, regions and even in different offices within the same region. Factors which can influence why processing may take longer from one visa office to another include the number of applications received, particularly if there is an existing inventory which has to be processed; resources in a given office; a higher need for medical and security screening; poor to no communication via phone or mail, the safety and security of staff, as well as emergency situations or crises that affect workload and priorities.

CIC continues to work towards global service standards and the use of departmental standard forms to minimize such regional variations as much as possible.

Citizenship and Immigration Canada (CIC) is working to closely manage arrivals in Canada, so that we meet, but do not exceed the 2011 Immigration Plan set by Parliament in November 2010. Since we have larger inventories than limits within the immigration plan for admissions to Canada, we must stagger the issuance of visas throughout the year. As a result we will not be in a position to issue immigrant visas to you until late 2011.

During this time, the department received applications for more than 425,000 people, and 144,000 of these have not yet received a decision.    
 
This number represents more than twice the number of projected admissions under the Federal Skilled Worker program in 2011, so many of these applicants will have to wait two years or more to be processed.  Because they reflect Canada's current labour market needs, applications under the most recent set of ministerial instructions are processed on a priority basis.
 
Our office sends immigration decisions and information requests by post or by email to the mailing and email addresses provided in the application. Therefore, it is important that our office be notified immediately of any change of address and contact details.
 
We thank you for your patience and for keeping your correspondence to a minimum.

It's not fair at all they are even unable to predict a clear time line, they are not different or efficient then any Third world Country what a shame, they are making thousands of people fool.

Do u mean that u have sent CSE on 10th Nov.....Right.....I have sent on 3rd November alongwith request of address change and address changed within 48 hours but still waiting for reply on CSE..........

Just wondering, If I go back to my country (India) as my visa is expiring on April 2012, is it possible to get my file transferred to New Delhi or my file will be accessed only in Sydney (AUS)Huh?

Please give your comments....

Hi Ritu,

Don't worry, your CSE is different about updating something. Mine CSE was different about my processing time which is easy for VO to reply. Because they reply with same message to all pre June applicants. As I know u r post june 2010 applicant. you can expect your medicals at any time during next two months if everything on the roll.

And yes you can change from Sydney to New Delhi visa office for sure is you don't want to stay further than April 2012. and let me tell you New Delhi office is much quicker than Sydney. As they have more staff. If next year I don't get any news from Sydney VO then I might change it to New Delhi as well. I have applied for Australian PR as well. My bad luck is that my application process to both countries are on long track. Your situation is much better. Best of Luck

I asked the same question on other forum regarding vo changing and Mitali told me that its not possible as when vo gonna ask for passport then we can't send passport overseas, then it might gonna be trouble, mine problem is I don't want to extend my stay over here as my visa class 485 expiring in November and no other visa I can go with?Huh

Hi Mehulca,

As everybody is getting reply from Visa offices for two years wait. then I think you can get medicals probably in the beginning of next year. Rest is your luck. But ND VO is better than Australia. They can surprise you anytime.

Hi Ritu,

About changing your visa office if Mitali said so, then it might be true, because she does research before suggesting anything. You might not be able to change visa office while you are here in Australia. Once you move back to India then you can transfer your file (as per my opinion). By the way why don't you apply for 885 subclass (PR). I had 485 as well then I applied for 885 which gives you enough time to wait. You can earn $$$ until your file is processing.

About changing your visa office if Mitali said so, then it might be true, because she does research before suggesting anything. You might not be able to change visa office while you are here in Australia. Once you move back to India then you can transfer your file (as per my opinion). Thanks Sukh, for your supportive suggestion about Australia, my problem is I don't have kitchen experience which put me short by 10 points as I need 120 points and lawyer said that option with 7 in each (IELTS) that is no longer exist, we have to submit this result with application.....that is why, I have very bad agent, who is not saying any words out of his mouth.....
I really want to be in Australia but can't do it.....I don't want to go with any student visa, if I can do it.....

Regarding Canada, my representative said that file can be transferred to Delhi.......
