Got NER this friday from CIC. I submitted my complete application package last year in October and in November my credit card was charged with first level of screening got cleared. I was quite happy at that time, I thought my application is now through the system and that too without any help of consultant. I applied under NOC # 4152 and with all experience certificates I could not please evaluation officer. I got mail from the evaluation officer that he is not convinced with the job responsibilities I have shown. I don't know what responsibilities they were looking for, though I mention job responsibilities as defined in NOC category.
At this point of time I think I have been defeated by immigration consultant/agents who take guarantee to get application processed with file number.
What senior members of the forum would comment on my situation? Should I go with agent now or is there a way that I should get my application review again by CIC?

Hey i had a question. Would they return all your supporting documents you submitted with your preious application ? And also would they refund your money ?

I hope things work out. I am expecting a PER/NER soon and so am worried.

HI Navneet,

Sad to hear about your rejection....

As per Evaluation Officer, he was not satisfied with your job responsibilities for NOC 4152. Have you copied the responsibilities same as per the CIC NOC category....?

If your NOC is available, I suggest you to apply directly bcoz you know where you need to improve in the application.

I have applied by myself and got the first AOR for NOC 1111. I had defined my own Job responsibilities which were not exactly same as CIC.

I suggest you to go thru the job responsibilities and change it accordingly and re-apply.

No Consultant gives guarantee for Immigration.After paying, you will become more dependent on them for each and everything.

I'm sorry for you but look DON'T GIVE UP.

The visa officer must support clear evidences about his dissatisfaction.  He has to be clear and give you the chance to defend it. THIS IS YOUR RIGHT.

You need to handle this with utmost care and diligence without overreaction. Write him a thorough email showing and demonstrating your competencies and experience and providing various evidences.

I suggest you read an article on similar experience and what people must do. Click on the link in my signature, from there, you will find a link on what to do if you get a rejection letter.

Life doesn't stop at this point. You fight back with solid arguments and I'm confident that you will make it thru.

Mezo,

I could not find relevant information for applications under FSW category. Appeal can be done under family sponsorship only. There seems to be no way that applicant appeal against NER under OP21. If you know any specific link please share.

Yes you are right, however, this doesn't deny us the right to question the visa officer first before you proceed, if needed, to the judicial review.

CAIPS should include all notes about your file. All OP's manuals clearly request the VO to enter related notes into CAIPS. So it should contain all concerns about your file.
