getting married while visiting..

me and my girlfriend (applying for tourist) we're planning to get married here in canada..

her uncle is living here for 7 years and willing to sponsor her visit..

questions:
1. if she's asked for her intensions visiting here, what would be the best answer?
2. if she answered 'just to visit my uncle, cousins' and not telling that im here, would that affect our 'soon marriage'?

need some help pls..

Visiting relatives, tourism - Canada is after all a beautiful country. How can they tie you up with her application? Anyway if she can demonstrate enough ties to convince the visa officer she'll be going back once her visit is over, then she has a good chance at being granted a visit visa.

But if she doesn't get a visa, you can always go to the Philippines and marry her there, then apply for spousal sponsorship. I've been reading posts about spousal sponsorships that have proceeded smoothly and were done in less than 6 months. All the best to the two of you=))

up to what extent is the sponsorship and guaranty that the person being invited will definitely return to the Philippines after the short visit.

employment cert, itr, house/land titles, etc

completed visa application form

school registration

bank cert and bank statement

There are no guarantees when applying for a visa. Burden of proof is on your girl friend- to show she'll be going back home after her visit [which clearly is not because you want to get married in Canada ]. If she's working, a certificate of employment and an approved leave of absence might help. There is an application kit available at the CIC-Manila website. Check that she accomplishes that together with the TRV application form.

Here's my take on this.

The reason for visiting Canada, to be stated in the application for a visitor visa, could be (1) to visit, or (2) to visit AND get married.

If the applicant uses (1), and subsequently gets married, Canada could feel that you misrepresented your case for a visitor's visa, and look suspiciously at any subsequent applications (such as for permament residency).  You don't want this.

If the applicant uses (2), Canada might well refuse the visitor visa for fear that the applicant will want to overstay the visitor visa, to be with spouse.

So, I'd use (2), but I'd make sure to have lots of valid reasons to prove intent to return to the home country: e.g. to clean up affairs, sell house, complete job contract, etc etc. Mention that you intend to apply for permanent residency under the Family category while you are back in the home country.

Or, failing all this, use (1) to get a visitor visa, do not get married in Canada, but rather get married in the Phillipines and apply for (spousal) residency from there.

purpose of trip / duration of trip I should think this is the applicant's, not the sponsor's worry

up to what extent is the sponsorship and guaranty that the person being invited will definitely return to the Philippines after the short visit. if the invitation is in the form of an undertaking- like responsible for room and board, medicals, etc, I don't think or I don't know if you can actually guarantee a person's return to his country of origin if the person didn't want to, short of reporting him or her to immigration had he/she overstayed =))

bank cert and bank statement make sure she can explain how she came about having the money it she's still a student as you mentioned in earlier post
