The Full application which I sent on June 21st is returned to me on September 3rd for lack of sufficient documentation on my legal entry to USA. I have 60 days in all to respond with this proof. When I send the Full Application again -
1. Should I send the whole package that was returned as is along with the additional documentation?

OR

2. I need to date & sign the initial document again with current date and include additional documentation

This question stems from the fact that they stamped the first page of the application with the date of entry along with some other hand written stuff.

Show us the letter that they sent to you. They must have asked you to send the missing papers not the ones that you sent already. if they have returned the whole package then send the whole package and withtin that the missing ones they want now.

Remember to attach a cover letter of the letter they sent you ( the 60 days's letter) and a cover letter about the papers you have newly attached.

That will do !

Thanks for the advice. I am planning on doing exactly what you said.
They returned the entire package and mentioned they did not keep a record of the documents. They did not even open the sealed education transcripts.
Notice letter pretty much states what I already mentioned along with regulation numbers, standard language etc.

Did they assign you any case # or file #?

Carefully look for these numbers. That is your key to ensure that your application will not be considered a fresh application.

As you mentioned that the first page has a date stamp on it and they gave you 60 days, I am pretty sure you have some sort of case #

Secondly, what did you sent as a proof of legal entry to USA. I sent my I-20, Visa Copy, I-94 and EAD cards. They were okay with that.

what documentation about your legal entrance or status in US did you send in the first place?

Here is what I mentioned in another thread.

My Full documents are delivered at Buffalo on June 21st. I sent an inquiry through Buffalo Consulate website on August 20th asking about 2nd AoR. I received standard reply. Today (September 3rd) I received my full package back (without 2nd AoR). Inside notice states that I need to provide proof of legal admittance into USA (I am Indian national). I have 60 days to submit from the date the letter was   created, which is August 03, 2010 (this date is stamped with a rubber stamp). This really means I have only 30 days, which is not a problem in my case.

What proof did I provide initially for legal admittance?
I sent my stamped visa in my passport which shows the H1B is issued for 3 years.

What proof Buffalo asked me to furnish now?
1. Entry & exit stamps in my passports (expired or current)
2. Documentation on date of admittance & validity (expired or current)
3. I-797 (H1B)

The best proof is your I-94. Send a copy of your I-94 (front and back) and also send copy of all passport pages which are endorsed. Last but not the least I-797.

Visa itself doest show that you were legally staying in USA. Visa is just good for entry into US. For example, I came here on F-1 visa 5 years ago. But i sent copy of my visa, I-94, I-20s and copy of my work permits (which i got during OPT).
