It means that between March and September the 38 list was not there, it was finalized sometime in October, so they cannot deny an applicant with something that came later...

I can't tell you for sure, but it should be applicable for all visa offices. (as the complaint was put by Consultants all over the world) ....r u using a lawyer or consultant??

no, i applied myself. My application is pretty weak so i dont really expect the PR (even though i am hoping for it lol). It would be nice if i am declined or put in process soon.

I am a Teaching Assistant with college like lecturer's duties so I applied. Everything is kosher in terms of my duties listed but I would understand if someone else would not believe it. I think if there was no separate NOC for TAs then it would have been okay but since there is a separate NOC for TA, it makes it hard. Also, I did not do the IELTS, no time. One of my PCC was more than 3 months old since date of issue but this one is not so bad since I hadn't been in the country for about 4 years.
On the positive note, I hadn't intend to move to Canada without a job offer anyway. While job offers are harder without a PR or citizenship, it is not too bad in my field. So if I do get a job offer then I would get PR anyway.

I am surprised that you chose FSW category 1. Why didn't you try category 3? If you did then you would not have had to worry about the list of 38 classes of professions! You are in Canada already for more than 12 months! Who can fit better in category 3 than you?! CIC processes category 3 fast because they give priority to those who are in Canada already than those who are "fresh off the boat". I myself am pulling my hair since I left Canada 5 years ago. It is too late for me to try category 3. So, category 1 is of concern for people like myself, not you!

I applied on 23rd dec through buffalo and got AOR on 2nd april. They have chaned my ecas status from in process to application received. There has been no communication from then.
I dont know where is my application sitting. do they transfer to cio sydney. I applied under AEO cat.which dont need to go through CIO when i applied.

Guys i will be sending my application to Buffalo visa office too, Buffalo seems to be a nightmare recently ! i think the big problem that makes Buffalo office very slow is the new immigration category (the canadian experience class), as they state in their website that all CEC application will be processed at buffalo even if they are applied outside canada or the states, they will be transfered by the local visa offices to buffalo. so buffalo now is processing applications for the USA residents, canada residents, CEC around the world.
Another important thing i noticed that they give the priority in processing for the CEC applicant and i believe that it is the main reason of the very slow processing at buffalo visa office for the FSW class.
