This piece of information will be useful to pre-June2010 applicants.

Under changes to the Immigration and Refugee Protection Act, federal skilled worker applications are assessed for eligibility according to the criteria listed below. Note: This does not apply to applicants intending to live in the province of Quebec.

These criteria affect you only if you applied on or after June 26, 2010. If your application was received before June 26, 2010, it will be processed according to the rules that were in effect at that time.

Note: If you are applying under one of the 29 eligible occupations, as of June 26, 2010, a maximum of 20,000 Federal Skilled Worker applications will be considered for processing in the following 12 months. Within the 20,000 cap, a maximum of 1,000 Federal Skilled Worker applications per eligible occupation will be considered for processing each year.


Guys,there is no point being apprehensive over the new limit as those that applied before June 2010 will be treated based on old laws.

Hi Ferndandez,

Thank you for the clarification, however, I do have a question, does that mean if there is a category NOT on the list of 29 professions listed on their website can I still apply?  I mean my job description does fit one of the criteria on the NOC website it just is not on this list.

If your NOC is not on the list of 29, you will need a job offer to apply.

Sorry to say you cannot apply unless your job description does not match anyone of 29 NOCs. But you can check whether your work experience reflects the criteria of one of these 29 NOCs inside the NOC Code list at the below link. If your experience meets one of the occupation structures belong to 29 NOCs, you are eligible to apply FSW under new process, post 26 June. Currently two NOCs, 1122 Professional Occupations in Business services to management and 3152 Registered nurses have reached the CAP. Apart from these twos, the remaining NOCs are still opening. See the numbers of application per each NOC.

According to above information the total applications so far are around 6,200 out of a total of total limit of 20,000. With another 6 months to go for the deadline of 26 June 2011 only pharmacists and dentists may reach the 1000 cap. Doctor specialists and general physicians it is understandable that they may not even cross 500 mark for the obvious reasons as they have to start from scratch along with others including dentist, pharmacists and nurses.  Nurses will find it much easy to re-train as compared to a specialist doctor. The higher you are in the skilled category the more difficult it is to be able to practice in your own profession in Canada. The word used is retrain but in effect it means back to school.
 
I have been wondering about the reasons for the poor response to the 29 ministrial instructions.  Any one with views on the issue please share your opinion.

Secondly, I do not expect 10,000 mark to be reached by 26 June 2011. Just wondering what will happen to the good 10,000 visa quota in such a scenario? Will it go to the 39 category backlog cases or pre-Feb 2008 cases? Please share if someone has an opinion on the issue.

Would you please tell me if i should still apply for the category "Professional Occupations in Business Services to Management" although it has reached the cap?  I am wondering if i apply now would it still be in the queue for the next year? OR should i wait and apply after June 2011 in order to qualify for the next cycle? Thank you

If it is still in the list, you can apply after 01/Jul/11.
