Author Topic: Federal Goverment plan to limit acceptance of Skilled workers to 38 occupations  (Read 7264 times)

According to Ontario Immigration Minister Micheal Chan,The changes were discussed at a meeting between Immigration Minister Diane Finley and her Provincial Counterparts in Ottawa earlier this month.Now the Provinces are concerned they will have to expand their own Immigration Programs  according to Chan.Those whose occupations are not on the list would have to apply through"Provincial nominee",a move that downloads a large part of the immigration burden on Provincial goverments(More work sigh....)The Federal plan would require economic class immigrants to clear 2 hurdles,Occupational test then the point system.

So when do think the final draft of the new occupation list will be released.

it means that new applicants will be coming under the newly released list.

If the conservatives win reelection which is 90% likely this Oct 14,Expect it in 2-3 months,If they lose It will not push through

what will be the fate of already applied applicants
might they can be neglected i f they does not come under the new 38 occup. list
or they will be processed by the same speed?slow and steady winns........

The new law allows the Minister of Citizenship and Immigration to issue instructions to prioritize certain categories of applications received on or after February 27, 2008, and to return, unprocessed, applications that do not meet the priorities.

What is says on http://www.cic.gc.ca/english/department/media/releases/2008/2008-07-03.asp is this:

To meet the 2008 immigration plan, which calls for the admission of 240,000 to 265,000 new permanent residents, CIC missions around the world continue to process applications submitted before February 27, 2008, the date the legislation takes effect. With wait times exceeding six years in some categories, few missions are currently processing applications received in 2008, which is expected to be a transition year.
...
Applications from federal skilled workers who already have a job arranged for them when they arrive will also be processed. Other applications received on or after February 27, 2008 in the federal skilled worker category will be considered for possible processing once the instructions are issued.


So if you applied before February 27, you are under the old system where you wait your turn.  If you applied on or after, you will be processed if you have a job offer, otherwise you wait until the list comes out and what they plan to do if you are not processed within a year is to return your application and fees and you can decide if to apply again.

Moreover,

At least we can be sure that these occupations definitely won't be in List-38!

I was in a Dinner last night with Federal Minister James Moore,But He was tight lipped about the changes planned,He said lets form the Goverment first.Sorry No news from me of what the 38 will be,But so_simple has good clues

So what does this mean for an application that was filed under NOC 0412 in June2007 ?  Is this a favorable catagory or one that will be sent back?

You will not be covered by any changes,only those filed after the changes
So what does this mean for an application that was filed under NOC 0412 in June2007 ?  Is this a favorable catagory or one that will be sent back?

I made an error - I meant a PR application filed in 06/2008 as skilled worker under NOC 0412 - is  this a favorable catagory or could this be sent back without action based on what we know?
