Thanks KayCee.  I took GK's advice and sent off for the state background checks just in-case.  It cost me an extra $50, but it's worth the peace of mind and saving three weeks if they happen to ask for it.

Since the CIC can ask for state background checks, I would suggest doing them in advance if time is a factor in your immigration.

Anyone have any experience with California background checks?  The form to request the check states that it cannot be used for immigration purposes. 

California does LiveScan clearances - which means if you're not in California it's going to be a bit more difficult to get one, but it can be done.  The info you need is on this page of the California Dept of Justice website - about half way down the page in the right side column.

"Individuals not living in California or who do not have access to Live Scan services must use the manual fingerprint submission process. Mail documents and payment to: California Department of Justice, Record Review Unit, P.O. Box 903417, Sacramento, CA 94203-4170.

Married Sept '06 after 4 yr LDR.  Applied via outland ap in March 2007 -  refused Jan '08 due to inadmissible adult "dependent child".  Appeal filed Jan '08; still waiting for resolution.
