hi guys,
can anyone give me some solid advice pz.my ex spouse (the principal applicant) is not ready to withdraw my and my son's name from his application that he submitted before the divorce.i need to change my id n passport now. can i change them n can apply independently without reporting to cic about the change?or i first have to inform cic about the divorce and should wait for the withdrawal confirmation and then can proceed?
and i need guidance about the proceedure of informing cic as well, in case i need to inform about the change.
is anyone well experienced out there to guide me?Huh Undecided

Your post is a bit confusing ur saying your spouse is the principle applicant, what sort of application have you submitted? is it FSW or is it a sponsorship app?

It would have to be one of the economic classes.

You can remove your name yourself if you are divorced.  However, your son's name cannot be removed as he is still the principal applicant's dependent child.  It could be changed from "accompanying" to "non-accompanying".  Who has legal custody?  The child will still have to be medically examined even if listed as non-accompanying.  Write to the visa office processing the file, advise them of the divorce and that you wish for your name to be removed from the application as you are no longer an eligible dependent.

You say your ex is "not ready".  I wonder why that is?  Could be a points issue.

thanks rjessome.my ex has submitted skilled worker imigration application n he added me as dependent. he is counting on my points n for this reason he is not ready to remove my name. i have full custody of my child.now i need to know,
 -how should i proceed with my case??
 -is it necessary to withdraw my name and then change my id and passport after getting confirmation of withdrawal?
-will it effect my imigration application as main applicant in the future if i dont inform visa office and just change my id?

You know, if your husband cannot immigrate without your points, then when you want to immigrate he may make it difficult for you to do so by trying to prevent you from taking your child with you.

True.  However, if they are divorced and her name remains on the husband's application for points, this is misrepresentation and could/would harm any further application she may make independently.

Yes. If the visa office finds out you didn't take your name off your husband's app even though you were divorced, it will be seen as misrepresentation and you will be banned. And they will find out - you'll have to submit your divorce papers and custody papers for a new application.

yes, that would the misrepresentation and i dont want anything that creat problem for me in the future as i already have many complications in my case.but i am confused by the remarks of canadianwoman that  my ex spouse may make it difficult for me to apply independently by trying to prevent me from taking my child with me.

-what kind of problems he can create for me if i have full custody of my child?
and
-wil i require any documents from him for imigration once i register my divorce and get my id n passport changed?

I think CIC requires that the non-custodial parent agree to their child immigrating to Canada.

Thanks canadianwoman for this information.i would apprieciate if i can get details about it.
my ex spouse never took ANY parental responsibility and i am taking full responsibility of my child since years, do i require permission letter from him even in this case?or i just have to provide proofs to cic about the irresponsible attitude of my ex spouse through documents that prove the fulfillment of liabilities of the child by  me only and not by him?
as i know my ex will never cooperate with me for imigration.
