Dear friends
 
I had been applying to immigration to Canada as skilled worker in 13/7/2008.

I had contacted the visa office to check my application status and they informed me that HE Minister of Citizenship, Immigration and Multiculturalism issued new instructions, which affect applications submitted on or after February 27, 2008.

According  to these instructions Application will be eligible to review if  under specific circumstances on of them is If the applicant is a skilled worker and has at least one year of experience in one or more of the 38 occupations listed .

In addition, they informed me that a decision has been made about my application and the office well contact me concerning it.

In my case when I sent my application I was started working with local social institute As paid part-time health and safety instructor from: 1/7/2008. NOC code 4131 College and Other Vocational Instructors.
During the coming days  I will have more than 1950 working hours in this job Equivalent to one-year full time job)

Therefore, I think that I am now eligible to apply as skilled worker under the new instructions,
•   Shall I contact the visa office to informed them about the new development??
•   Could they put my application in process again?
•   If it not possible to put my application in process, I am willing to send a new application to Sydney, NS
•   In this case, did they consider the first fees payment ? or I have to pay new fees.

You need a new application, they will not amend you present application.  If the instructional job is PT, how would you be able to get 1950 hours in 15 months and have another full time job?

Thank you very much for your respond.

 

Its simple formula:

 

28 working hours per week from 1/7/2008 -8/11/2009.

 

4-8 pm Sunday to Thursday and from 8 am - 4 pm in Saturday.

 

70 weeks – 17 months.

 

My full time job from 8-am to 3 pm  Sunday to Thursday Friday and Saturday day off.

 

Please , What do you recommend me to do ?

 

Shall I contact them first or withdraw my first application or what?

You need to make a fresh application and pay the fee again, the fee you paid earlier will be refunded to you in due course, there is no point to contact CHC about your existing application if decision has been made which means your previous/existing case is now closed. Be quick to make new appliction before anything changes again !!

please have a clear idea of what exactly are the old rules and the parameters changed under new FSW category and then suggest your opinion.

dear ha4578,

first it would be better to withdraw your application. Regarding your refund there are chances you might or might not get depending on the phase of the process. So once after you withdraw the application go through the NOC and make sure you don't copy paste the required job responsibilities for your NOC, mention something similar details and some good number of points would surely add value for your application. also you have to make a fresh DD in the favor "receiver general for Canada" for $550 and send the initial documents to Sydney Nova Scotia ... for initial screening of documents..

Also please refer cic.gc.ca for further clarifications. But before taking any of the advice i would recommend to go through the Canadian immigration website cic.gc.ca as its the best guide and source for information...
