Hi everyone

How Are you guys? Please Answer my question if you can? I have Applied as A Drafting Technologist NOC 2253 Non Regulated profession with AEO i have 78 Points as per caips notes Selection decision and paper decision has been made by VO since last year.

But VO has questioned my IELTS score

L 5 R 4.5 R 5.5 S 6 Overall Band 5.5

VO Said i am not satisfied with your ielts score i have provided him many evidence like i will continue my studies in canada after arrival.
Also my employer had given him letter that we dont have any problem with applicant engilsh if we feel we will give him chance to upgrade himself.

Also i have sent him some certificats about english language coures from British council.

As per New proposed immigration regulation people who are on NOC Level B will be immigrated with low ielts score does this policy will benefit me or not.
my noc on level B  I appliy in june 2009.

If i am old applicant does they will refuse or not if yes does this is good for canada that someone on final stage of immigration they will refuse and tell him to apply on new regulation.

New Rules are usually applicable to fresh applications only. As of now you know nothing of what the new rules will specify for B level NOC's as to what min. IELTS score will be good enough for you to qualify.

Since you have already submitted your clarifications to the doubts raised by the VO in your earlier application, wait & watch.

What do the SELDEC & PSDEC codes in your CAIPS say?

That is good. Most likely you will receive medicals soon. What is the BFD on your CAIPS?
SELDEC 4 means that the VO has kept decision pending based on the response to be received from you before deciding. Since considerable time has lapsed since you sent the additional documents, it is most likely that your file has been reviewed subsequently. If it had to be rejected, it would have been by now.

Stay positive. Is your e-cas 'In Process' right now? The delays are procedural & normal, do not worry.

BFD was 18 january 2011 nothing received yet by now hop for good news but i dont understand why they will refuse old applicant and give chance for new applicant i mean to say that if you quilify now as per new regulation and youe in process then why not giving benefit right now why they will wait for new applicants then long way again.

Dear Friend, CIC has never been fair to older applicants whenever they have come out with new rules.
People have been waiting for 4-6 years to get Visas those who applied before 28 Feb. 2008 & even now people who applied after 26 June 2010 are getting priority processing as compared to pre 26 June applicants.
So this is the way of CIC, you cannot justify anything !!

CIC & Immigration Ministry have to keep reviewing the rules so as to refine the Immigration program & match the requirements of  the current demands of the labor market in Canada.

It's just hard luck if you become the victim of change in policies.
However hang in there, your application will get a positive response soon. Smiley

IMHO, I would say, don't be fooled. Nothing new will favor the oldies as per the immigration rules.
The oldies are almost forgotten, they just cannot cope with the oldies files, as new ones just keep coming in and piling -up on top of of the old ones.
It looks like if you make noise, then they try and find your file, and if you are still within their AOR dates (even if you are not), they either keep quiet , or just respond with a standard format.
However, Drooza, If you have enough time and can stand the stress and frustration, then by all means just keep waiting until your luck strikes.
