I applied twice, while in Canada, under the Humanitarian and Compassionate case.  I was denied both times, not because of inadmissability, but because they did not find that me applying from outside the country would consititute undue hardship, so they did not grant me an HC exemption (this was back in 2002).

My question is:  I am no outside of country and applying as a skilled worker.  Will the fact that I previously applied under a totally different category and was denied, now hurt my chances?

Thanks in advance to anyone who can help.  Anybody ever had the experience of being a denied and being successful a second or third time?

Hi

If that was the only reason of your rejections past two times then NO it wont hurt but do mention in the forms where it asked that you did apply before as well.

From what you have said , both your denials were because of a technicality. That being the case It shouldnt really matter at all in this case. An example of where it would have mattered was if the denial had been based on failing a background/security check.

Thanks so much guys, very helpful.  I didn't think it would matter, since the denial had to do with the way the application was set up at the time (unless you could constitute severe suffering or hardship from applying outside Canada, you couldn't do it - now they have the Canadian Experience class, but too late for me)!
