Hi,

My current Work Permit ends on 15th June. After that I will be put on implied status. My LMO is filed. My wife is expecting July end. If my LMO comes -ve say on 15th July, will we be asked to leave the country with my wife in her 9th month pregnancy. What is the option to stay till delivery is done and then leave the country.

Kindly reply fast as I have to take some hard decisions.

Hi,

Does anybody know this. I can restore status as a visitor and continue to stay? Is this correct?

You need to file an extension of your work permit before it expires to be on implied status.  File the extension to the work permit two weeks before it expires.  If you receive a positive result to the LMO, send Vegreville a copy.  If you receive a negative result, your WP extension will be refused but you are still on implied status until your receive the refusal.  At that time, you can apply for Restoration and to change your conditions from worker to visitor.  You need to think about health insurance.  When your work permit expires, you are no longer covered under most provincial health care plans so you will be paying out of pocket for the delivery of your baby in Canada.  Talk to the provincial health insurance provider about what you can do to get the health insurance extended as I have heard of some willing to extend for a couple of months with proof of application for a new WP.  But you need to TALK to them as each province has it's own rules.

Thanks rjessome. You have come as God send for me.

The best news you have given to me is that I can convert to Visitor status even if my LMO comes negative. That ensures that I dont have to leave the country with a 9 month pregnant lady. Regarding funds, I am working on that.

One more question.

LMO can come negative in 4 - 6 weeks. Will HSRDC immediately inform CIC of the LMO decision. CIC takes 3 - 4 months to process an application. In this case, will it process the application as soon as it recieves negative LMO or take its own sweet time of 3 - 4 months.

How much time will I have beetween negative LMO and the CIC WP refusal.
