Hi,

Your wife can apply again but it depends on the reason for refusal. If the application has been refused because of fraudulent documents , I am afraid to say she can't .

There are so many people on the forum whose application got refused,they reapplied and managed to get visa as well.

it is relieving me from all this devastation that is happening between me and my wife. i most probably think it was because of the documents that the embassy thought of being fake documents. regarding her COE that was indeed given by her employers. im not really sure. but if it was, we can prove it as authentic bacause my wife even provided her payslips,employment cert, ID,contract,and so on...

we didn't had our medicals yet... thanks really! Cheesy

After Medicals, there is rare chance of getting denied until something INTERESTING shows up in Security/ Background checks.

People generally go out rejoicing and have beer with friends  Grin Grin after Meds because at this point if the applicant is sure that nothing would show up in bC/Security then he ALREADY has his PR in his mind...does'nt he? ...He just have to wait...that's all which should not be that bad in comparison to the whole procedure Grin Grin

So, if you have'nt yet had a beer...then this is the time. Cheesy

Dear Mitali,

Thanks for your reply. Smiley I just another question and I hope you could take time to answer it. Smiley Me and my Wife are done with our medical examination last September 14, 2011. I just have a concern with the APPENDIX A of the MR form given to us. It has some discrepancy when it comes to the MARITAL STATUS of me and my wife. We are legally married but on my form, may status was COMMON-LAW when in fact it should be MARRIED. My wife's form shows MARRIED. We didn't bother to correct it because we thought that it might just be a human error on the VO's end.

Will this have an impact to our application? I'm thinking this might cause confusion to the VO and might delay the processing of our application.

Hi mastcanada,

The reason your application got refused is because you had initially did not show any POF as you HAD A JOB...but when you moved to INDIA that job was no more available and thus your prev claim of not providing POF based on the fact that you have a job is NULL and VOID.

The ONUS is always on the candidate to provide enough proofs to CIC (even if they write - Nothinng is to be done from your side....send emails, CSE or FAX)....if they do not find enough documents on file they will just reject it....they do not have time to pursue further investigation. And in this case when you did not have a job then you should have provided current POF to CIC and then the processing would have been POSITIVE in your case.

How do you think CIC would approve your case with absolutely NO information on POF which is one of the most CRUCIAL yardstick for PR approval? There was no basis for CIC to approve.

I have elaborated my answer for other new members to get an insight....

I sincerely hope with the new POF that you have sent, VO will RECONSIDER your case. It is already over a month....time for you to write them again...send them mails/fax/etc...just be on top of your case.

Yes Program Integrity is always in place. The candidate cannot request for a change of VO because he will not be granted. But at the sametime the candidate has to inform the VO and only if, the VO thinks is viable under Program integrity will his file be transferred.

CIC has to consider this many a times because ppl change jobs and continents and its in the best interest of the candidate (in case an Interview is required) that VO complies to such situations. Sometimes VO would retain the file at the original VO because he may think most of the information on file relates to local (original) information.

You should have corrected it....anyways whats done is done. I am assuming it will be dealt as an human error because your application would not have gotten this far with you as Common law and your wife as Married ( that category does not exist within CIC Grin Grin)......but no harm in informing the VO....do it asap.

Should not delay the process.
