Hi Friends,
There were lot of good news coming in these days and I thought my positive turn would be next, but it turned out to be negative and I have a sad story to share...
If u see our time line, my husband had applied under 0213 on Dec2009 and everything was smooth till last Tuesday (31May) when our ecas changed to Decision Made. No processing date inside, same inprocess(RBVO) details with a last line saying ‘A decision has been made on ur case. The office will contact u concerning the decision'. We thought it might be the ongoing ecas error. But unfortunately, today we received rejection letter from Los Angeles VO dated May 26,2011 saying the following lines:
You have indicated that you have work experience in an occupation with the following NOC 0213-Computer & Information Systems Managers. Although the NOC code corresponds to the occupations specified in the Instructions, the main duties described in your employment letter from ------Company do not indicate that you performed the actions described in the lead statement for the occupation, as set out in the occupational descriptions of the NOC or that you performed all of the essential duties and a substantial number of the main duties, as set out in the occupational descriptions of the NOC. As such, I am not satisfied that you are a Computer and Information Systems Manager, NOC 0213. Since you did not provide evidence that you have work experience in the listed occupations, you do not meet the requirements of the Ministerial Instructions and your application is not eligible for processing.
In fact, my husband had provided the original work exp letter with all the duties & responsibilities related to his exp as a Manager. Most of the duties & responsibilities in the original exp letter were same as the ones he had mentioned initially in the work experience column of the CIO-Sydney form .my question is, when the same points were considered eligible by the CIO-Sydney visa officer, what made the LA visa officer to reject when we had provided the original exp letter including the same points. Moreover, there were many constraints in obtaining the original exp letter.
Now he is planning to write a detailed re-consideration letter against the points of the Visa officer and he will be highlighting the CIO-Sydney point too. Also, I need valuable suggestions & prayers from all the forum friends to make this a positive turn.
Now, to whom should we address to? In some instances I have read ‘address to the Program Officer', who is the program officer? Is it the same visa officer or some higher officer?
Another important query...My husband has been writing research articles and has been published in online journals. Can this be mentioned in the re-consideration letter as this is purely technical in nature and they might not consider him to be a manager.

Hi Pearl, Sorry to heard that, the program officer is higher then VO, initialy the low-level clerk VO initialized the application then top level VO decide to accept the case or reject it and based on re-mark of low level VO.
This kind of rejection generaly due to : "Simillar or exact text match with sample NOC role and duties title mentioned in the NOC sample list on CIC, some people before rejected due to the same issue , they just modified experience letter and added more similar or exact word match flavor of the duties and title mentioned in the NOC. this kind of experience certificate mostly VO ignored and issue rejection if the applicant failed to provide experience certificate but should not exactly the same as they mentioned on CIC website NOC sample. This is the first reason VO reject the case, more reason of rejection also include that VO call to the employer and employer not provide good enough satisfactory answer on related mentioned experience when VO called to them at the time of background check.
Remember "You may appeal within 30 days of issue date of refusal letter from VO". I am not sure it's 30days but I read somewhere outside canada applicant can appeal within 60days when they get refusal letter, but count 30days as per my opinion.
I am looking some post in this forum we have but I dont get right now, if I got something I will share it.

@ omm,do you recall any rejection case where applicant was over qualified for the NOC selected.

If you qualified in more than 1NOC is ok, good degree or master or Phd, but experience details same or similar or exact match with which sample provided by CIC that will cause rejection. look in this forum we have some cases who rejected becasue of experience certificate issue. I will share once I got it post which I looking for as we discussed in end of year 2009 to 2010. OMM

1. As omm mentioned that it could go wrong if duties are copy pasted from their site. My input on other issues are 2. I entered few points in application form when I sent it to CIC, since there was limited space, I could not enter much. (I filed my self and was not guided. I did not send any additional paper of my role & responsibilities). CIC office accepted & allowed me to proceed, so I don't think for pre 26 June applicant, CIC cross check everything mentioned in application but check it from Macro level, that what is claimed (and don't verify). -As per my CAIPS, at CIC officer checked my claim for NOC & recommended for further processing. -When my file was In Process, VO looked into submitted supporting documents for that claim Hope this would help you to understand why CIC accepted but VO objected. 3. I don't think, mentioning that your spouse's articles are published could harm. I am also technical manager, and I mentioned my role in my application. VO wants to confirm if broader role is matching or not. Sharing other responsibilities are not negative. Hope this would help & I wish your reconsideration application to be successful. good luck.

Pearl2010, I am so sad upon hearing this news. Well like you have said, he should write a letter for reconsideration. I hope they can do something. Yes, you have s aid it all life has to continue. I am putting it in prayers.

she seems so confident that her experience letters were rock solid. I'd appeal immediately or go to a Federal court if I believed that I wasnt judged the proper way.

Really feeling sad for your pearl. You have been so encouraging and also been positive towards life and future but I agree as you said this is certainly not an end of life....
Matching job description with respective NOC applied for has been a matter of concern for VO in many other cases to arrive at DM... I would suggest your husband to go ahead with the reconsideration appeal with as much as proof he can attach along in support of his role and duties... As its a paper based decision so sometimes related papers, photo and other evidential proof might support (who knows!!)... I also think it would be a wise idea if the reconsideration letter format as to be prepared by your husband could be shared personally and opined by our expert seniors and some forum friends who managed to succeed in reverting their case...
Don't loose you hope.... its all in the hand of GOD... who can make turn things in either way...............

I am so sorry to hear this pearl. I think like everyone said, you should appeal and add additional evidence of your job including jobs description since the application was filed. I have seen several reconsiderations after successful appeals on this forum. Don't be discouraged, keep your chin up and all will be well.

Hi Pearl,
I am terribly sorry to know of this rejection. Your husband must appeal for reconsideration. Normally, Counsellor-Immigration Program is the senior most CIc officer at a VO. I have read some where that all rejections must be reviewed by him/her before VO conveys such decision. I would suggest to address the appeal to this title.

Your job description/duties must match at least 70% with the job description mentioned against the NOC in their web site where NOC along with qualification and main responsibilities are given other wise you can not claim to be in that specific occupation. Kindly re check & match the job description your husband mentioned in experience letters against mentioned in NOC 0213.
did your husband got PA or not before this?
