"Provincial Nominee Programme"
 
   My girlfriend of 2 years has been offered a job as a nurse in Vancouver. We are both UK citizens and she has been told to apply under the provincial nominee programme (pnp) as it is a fastrack scheme. As a nurse she comes under the high skilled worker definition, I read everywhere that her spouse could gain entry to Canada with her and should they find a job they can apply for an EA in Canada rather than coming back/applying to the consulate in the UK. The problem is I can find no definition of spouse, does it include common law man and wife, if so what is the Canadian time frame before one is considered as Common Law.

If I am unable to gain entry with her under the PNP what route is availible. I beleive I may be considered as a highly skilled worker as I have an International Business degree and have worked in the Insurance industry since graduation 4 years ago.

I look forward to any information on this you could provide.

   Canada's immigration laws do not presently account for the possibility of a common-law spouse. The Immigration Department, however, does recognize that such unions exist, and have implemented policies which may allow for immigration on the basis of such.

Initially such applicants are considered in the skilled worker (or another independent) program. If the applicant does not meet the requirements of such, then Humanitarian and Compassionate grounds are considered.

In the latter case, documentation or other corroboration of the relationship is critical.
