"Company Collaboration outside Canada..."
 
   We're an incorporated company here in Canada, and want to collaborate with a company in India or Pakistan to get the services, and software development. My questions are:

- Is it OK to collaborate with the unregistered company in Inida/Pakistan?

- If not, can the company be Self Proprieter?

- What prove we would be showing to the the Canadian Government (if required, suppose in audit) that we have collaboration with the company in India/Pakistan and getting the services from there. Will the signed-contract and invoices be enough?

   You have asked as to the implications of a Canadian corporation “collaborating” with a company located either in India or Pakistan to obtain services and software development.

In order to properly formulate a response, it will be necessary to know where the work will be performed and whether any Canadian individual or corporation will be actively involved in those services. Depending on the responses to these questions, certain structures are available including corporations, partnerships or joint ventures. Each has its benefits and disadvantages and should be looked at in detail once the goals are defined.
