"immigration as a permanent resident"
 
  
Dear Sir

I applied for immigration in 1996.Processing took about 3years.
after interview i informed that i had recieved 72 point (means
2 point more than enough), but because lack of some information
(home rental status; how can I find a job;where are your
profassional related industries...)refused.

Would you please tell me :
1- may I follow the previous application or
2- shall I aplly again?

   There is no means by which you may pursue the prior application. It has been closed, and the delays for appeal have long expired.

It would be best to consider a new application, for which you may conduct a free online assessment to determine your eligibility.

   Dear Mr.Cohen,



I had applied for immigration (independent category) in May 1998 and received a call for an interview on 19th February 2001 i.e. after 2years and 8 months.

I had applied for an intended occupation of Financial Manager/Accountant as I have an MBA in Finance with 2 years experience in Accounts and corporate finance. The visa officer asked me whether I had a CA/ICWA qualification. I replied in the negative. He said, for the intended occupation of Accountant I needed to be one of these and may not be considered for Accounts as intended occupation.

Then he asked me whether I had experience related to portfolio mgmt or investment management. Again my answer to this was -ve. I tried to convince him that the experience and qualification I had pertained to accounts and Finance and urged him to look up a suitable "intended occupation".

He said he could maybe fit me as a "bookkeeper" but that is not what I want to do out there. Besides this would not get me enough points.

Now I have my maternal aunt in Canada as a willing sponsor. When the Visa officer asked me for proof of relationship I showed him the affidavit sent by her from Canada duly notarised by a Canadian immigration lawyer. It seemed that did not convince him and he asked for a better proof (like passport of my aunt before mariage) which would prove her relation to my mother.

While the interview progressed the officer kept taking notes in his laptop. During the course of the interview I remeber him making mention of the words "positive discretion".

In the end he said we will let you know about the outcome "several" weeks from now.

Where do I stand ? Have I qualified ? What do I do ? I am confused.Please help

   From the information that you have provided, it appears that the discretion of the immigration official will determine your eligibility finally. It appears that there were some shortcomings in the documentation which was provided. Also, it is not clear that an appropriate NOC designation was selected or that the Officer properly considered the designation of Financial Manager. The documentation may have negated the possibility of such, however.

It does appear, however, that the immigration official is sympathetic to the case, and may even be considering approval of the case if the points do not total the require 70 (positive discretion). If any additional documentation has been requested, you should be sure to provide it. Otherwise, only a communication from the visa officials will reveal the outcome.

   Dear Sir,

I had written to you and filled out an on-line assessment form . Your office had mentioned after scrutiny that I do qualify under the skilled worker category. The visa officer however does not think so , or so it appeared in the interview where inspite of my trying to convince him about the match between my education MBA(Finance) and subsequent experience , he said he does not think I have the required qualification as per Canadian visa manual which says I must be a Chartered Accountant or Management Accountant.

What do you think would be the outcome. Please advice

   The presentation of any case is critical to the outcome. You will note that our assessment response would have referred to this fact.

Without having had the chance to review the documentation of the application prior to submission, it is impossible to comment on the correctness of the decision.
