"Applying for PR with DUI/DWI"

   Dear Mr Cohen,

I am getting ready to apply for Canadian PR in Skilled Worker category. I was charged with a DUI a few months ago, but was approved for Diversion. This will allow all charges against me to be dropped in a year, provided I don’t violate conditions of the agreement. How does this affect my chances of getting Canadian PR? Is there anything that I can do to improve my chances? Does your Firm handle cases similar to mine?

Thanks

To determine whether or not a past conviction will be an issue in your application for Canadian Permanent Residency would require a detailed assessment of the conviction documents, describing the judgement rendered, as well as an analysis of the coding of the equivalent offense within Canada's own legal system.

We can say that in the case of criminal offenses a certificate of rehabilitation may be required from the Canadian Government, prior to an immigration visa being issued. Of those certificates that are granted, they are usually only given after 5 years has passed from the date the applicant has completed the sentence for the offense (such as probation, or prison time).
