"will i be able to stay in Canada during my application process"

   Hi,

I'm Turkish and have been living with a Canadian woman for 1.5 year. She is working in Turkey as well on a work permit as a teacher. We decided to marry and settle in Toronto. As far as i understood from the articles of the other people it takes some time to receive your visa. We will have been married in November 2001 and we would like to move to Canada in January 2002.

Will i have to wait for the approval of the immigrant visa or can i move to Canada and stay in during my application process? Is there a way that i can stay in Canada and wait for my acceptance to country.

My other question is; what are the difficulties of a Canadian sponsoring a relative, if she is working outside Canada and decided to go back to Canada and settle. Will she have to meet some special requirements.

Thank you in advance for your kind answer

Necati Adali

It is possible to seek admission to Canada as a visitor while a PR application is pending. Doing so will not harm your application for permanent resident status. However, your application for temporary status may be affected because an impression will have been created that you do not intend to leave Canada upon the expiration of your temporary status. Therefore it is better to apply for temporary status before you apply for your permanent resident status.

Other than a spousal sponsorship, it is not generally possible for a Canadian to sponsor an applicant while residing abroad. In the case of a spousal sponsorship, it is possible for a citizen to do so if an imminent intent to return to Canada can be demonstrated.
