"Child custody"

I am a father and a husband. I have a child from my ex-wife. The law of the land here in Oman is that the mother takes automatic custody if the child is under 3 years of age, providing that the mother is of sound mind and capable of looking after the baby. My ex-wife is disabled, she was disabled since marriage, she is a mute, and she agreed to hand custody to my current wife and I. There are no custody cases in Oman, how can I be qualified to emigrate to Canada with my baby son?


One more question is, for me to get the security clearance for immigration, I would need to get a security clearance letter from the Royal Oman Police inspector general of police and custom, and that letter is usually not given to Omanis, only expatriate have the privilege? Can this requirement be waived?

You will need evidence of the custody of the child to be eligible to include your son as an accompanying dependent. If a court judgement is not available, then you will likely need an original sworn statement from ex-spouse.

In regards to the police clearance, each visa official has the discretion to waive the requirement for a police clearance if the circumstances warrant such. You would need a written statement from the police officials stating that they will not issue a clearance in your case. If another police authority is capable of issuing the clearance then you should inquire there as well.
