"Medical Exam"
Hi,

My wife went under medical and according to the DMP she has a case of multi-drug resistant TB so she was given another set of medications. This shocked us as she completed her treatment a year ago and she was constantly in contact with her pulmonologist even for simple colds. We sought a second opinion from other pulmunologists and they were gave us the same response after tests were done on her sputum, x-ray, blood test etc. All other doctors advised her against taking those medicines as they do not find any need to based on their exams. Our problem is the DMP is the ONLY pulmunologist designated by the embassy. How do we refute his claim? We have copies of the test performed by the other doctors. In each consultation we do not mention that we are getting a second opinion as to get an impartial result. If the embassy refuse our application based on the DMP's report can we file for a reconsideration based on the result of examination of the other pulmonary specialist? Does the embassy accept that? Can we petition the DMP to be removed as this is a clear case of incompetence. He gave the medicines for MDR-TB without any other test aside from the x-ray which is in contrast to the three other doctors who performed other test to verify the result on the film. I've been reading a lot on MDR cases and there are several test involved before giving any medications, it is clear to us that he did not perform any.

1. "RE: Medical Exam"
A Desingated Medical Practitioner is required only for the purpose of conducting medical examinations, and not necesarily for follow-up treatment. The only instance in which such follow-up treatment may be required is in the case that a Medical Officer has requested additional tests following a specific treatment. Following such treatment would be at the discretion of the candidate in such a case.

There are cases of Judicial Review in which refusals on medical grounds have been sent back for review in cases in which evidence from specialists made such refusals "patently unreasonable."
