"About dependants, unwilling to pass medical exam"
Hi,

I'm temporary worker in Canada for about one year (Computer programmer). My wife and child are in Russia - my home country. Wife does not want to go to Canada, does not give to bring my child here, and also refuses to pass medical examination or to be involved in immigration process somehow. She gave me notarized "No objection" letter and signed application forms. That's all.

I applied to Buffalo and sent notarized declaration with my documents, stating that "...I understand and accept that if I am admitted as a PR in Canada, this will not oblige Government of Canada to grant admission to my dependants (wife and child) unless they satisfy all the requirements of the Canadian Immigration Act and Regulations in effect at that time...", and attached letter, asking to exempt them from medical examination. I marked my wife and child as "non-accompanied" dependants in application.

I've got Letter of Assessment several days ago, containing medical form for all my dependants. I also have to provide Police Certificate for my wife from Russia. The only good news is that I've got interview waiver.

Currently, I cannot provide medical examination for wife and child and also get Police Clearance for wife - she refused to do all these. There are no any chances. So, I'm in a difficult situation now. I talked to some person from Immigration Department, using new toll-free phone line for residents of U.S and Canada. She insisted on passing medical examination by all family members.

What I'm afraid the most is that if I try to explain to my immigration officer, that it is impossible for me to bring my dependants to medical examination and get Police Clearance for wife, my file will be immediately closed and I'll get refusal. What is probability of such refusal? What can I do to prevent such situation or at least to decrease probability of "unhappy end"?

Currently, I decided to provide all necessary documents from me as soon as possible (medical examination, fingerprint check from RCMP, ROLF). After that, when I make sure that all these documents are successfully received in the office and attached to my file (it is easy to get this information by using phone for applicants from Canada/U.S), I'll send fax, explaining my situation and referring to declaration, sent with my application. I think, if officer has all documents, showing good health and absence of criminal records in RCMP for applicant, and also paid ROLF, the only thing that he/she will have to do is to take decision about my dependants.

Is this right strategy for such difficult situation?

It is not necessarily the case that your case will be refused under these circumstances. You will need to provide another statement that you understand that failure to provide medical examination results for your dependents now may exclude them from eligibility for sponsorship in the future.

An affidavit from your spouse stating her refusal may also help.
