"Immigration to Canada"
Dear Mr Cohen

My husband and I ( and our 4 month old baby ) are currently preparing the documents for applying for immigration to Canada.
The principal applicant is going to be me.
We live in France now.
I hope you can help me with the following questions:

1. My husband has a 11 years old child born from a previos relationship ( they were not married ) who leavs with his mother in Peru. We do not intend to take this child with us to Canada.

a. Will this child have to go through medical exams ?
b. Will this child need to have a passport in order
to identify him self for this medical exam ?
c. Do we have to provide any legal documents regrading
this child ? We do not have any.

2. What is the nature of the background check done by the immigartion authorities ?
My husband is Peruvian. His name is so common in Peru that it has already happend in the past the people with the
same name were "wanted".
Last year he was put into the armee jail for 8 days just because a 19 years old man with the same name escaped the armee and despite the fact it is clear my husband is much more then 19 years old.
We are afraid that a similar case will perevnt us from getting the visa to Canada.

1. Details of any custody agreement and applicable Peruvian legislation would have to be reviewed to accurately determine if the child requires medical examinations, and to determine what documents may be required for the case.

2. All potential immigrants to Canada must undergo a background clearance to weed out those who have been or are involved in espionage, subversion or terrorism. This is to ensure that the safety and order of Canadian society are maintained and protected. Such security screening decisions are made based on information from every available source, which is then carefully weighed to determine whether an applicant is likely to threaten the internal security of Canada. When there is an indication of security concerns an interview will be scheduled to discuss these findings with the applicant. Anyone who poses such a threat must necessarily be prevented from entering Canada.

We do not have any documents regarding custody agreement .
Would this be a problem ? Could it delay the
processing time of or visa application?

The laws of your home country may make a custody agreement unnecessary. Such laws would have to be reviewed to be able to accurately advise you.

That is beyond the scope of this forum.
