"Marriage in Canada"
About a year ago I met a Mexican woman who was on vacation here in Canada. To cut a long story short, Alejandra and I have now been livng together since that time. We are planning to be married as soon as we can, however, I am in the process of getting a divorce, something that I should have done years ago. My wife and I have not been living together for the past 10 years. We have 3 children who are living with me. I hope to have the divorce finalized by the middle of February.

Can Alejandra and I get married in Canada and make an application for landed immigrant status here, or will she have to go back to Mexico and make the application from there? Money is obviously a problem if we have to travel back and forth to Mexico.

There is complication. Alejandra's mother came to visit just before Christmas. She has cancer and is now very sick, so sick that the doctor says that she shouldn't travel. Alejandra's current visa expires at the end of February and we must apply for a new visa soon. I am concerned that the situation may look as though she is just marrying me so that her mother can get into Canada to take advantage of the health system. This certainly is not the case.

What do we say on the visa application as the reason for requesting an extension? The exact truth, no truth, or a portion of the truth, (so help me God).

Once you are legally eligible to do so, and marry within Canada, you may seek to conduct a sponsorship application inland. If she leaves Canada is this scenario, she must seek readmission as a visitor upon each return to Canada.

As your marriage does not immediately affect her mother's eligibility for PR status in Canada, or for access to the Canadian health care system, that is not necessarily an issue.

You must be fully truthful on any application that you submit to Immigration Canada.
