   Dear Mr.Cohen

I'm a fellow member of the Institute of Chartered Accountants of India (passed in Nov 1989 - secured 50 th rank in the final exams). I have also passed my C.P.A. exams (in U.S.) in the year 2001. We have a multiple entry visa to U.S. for 10 years.

My application was filed on sept 25, 2001. I received my file No. on Nov 14, 2001. My initial assessment was completed on Nov1,2002. The High Commission has stated that my file will be trfd to New York in 7-10 months.

I have applied under the Manager Finance category. I have about 8 years of post qualification experience in the industry as Manager/Deputy Manager finance/Chief Accountant.I have also worked in A U.S. based software company for 6 months.

But for the last 4 years I have been practising individually and doing courses in computers ( Completed level 1 in Alliance francaise -french).

Kindly let me know whether I will be governed by the new regulations and how long it will take for the process to be completed. The recent 4 years of experience, is it taken at the time of interview or at the time of application?

In general is it risky in my case to apply to U.S. (because my salaries were not be comparable to those of U.S. multinational companies)?

Unless you receive an interview waiver or selection interview by March 31st, you will be subject to the new Regulations with a pass mark of 70. Given this fact, more details of your case would be required to determine your score under the new criteria, and an expected time frame for the rest of the case.

Immigration officials will often assess work experience gained after the submission of the case.
