   Thanks for the wonderful website and your fast-track responses to the participant's questions.

I had applied for the PRC under the skilled worker category in May' 2002. Received AOR in the first week of November'2002 stating that I will receive a communication within the next 30 weeks. I am currently a resident of the United States and my current work authorization will expire in May'2003. I hold a double Masters Degree from the United States. FYI, I had also submitted FBI Clearance and State Police Clearance as well, from where I reside.

Based on some of the postings and your reponses to those questions, you had mentioned that the second communication from the Buffalo PRC would be only within 52 weeks due to the current backlog and the reassessment of all earlier cases under the new criteria of 75 points. But you had also mentioned that if someone applies from with United States, the processing time would be 14 months.

Since I had submitted everything they had asked for in the first instance, would it make a difference in the processing times?

As I am in the beginning of the process of relocating back to my home country, India, as it took 6 months just to receive the AOR. I have certainly given up hopes on the Canadian GC.

Based on the above premise, would it be realistic to expect that I could hear from Buffalo PRC by April'03. If not, would I be able to transfer the file to India before I depart the United States?

If I write to them regarding my situation, would Buffalo PRC put my application on a fast track basis, which I think they should do or at least grant a temporary work permit as they do in the US, once you file a Adjustment Application or after a partial review that an applicant meets the criteria for the immigration benefit he/she is seeking and of course after satisfying all the security clearance.

If the Canadian Government is to really observe the spirit of the law in recruting skilled workers, who would benefit the Canadian economy, they should fast track applications for skilled workers. Applicants who reside and work legally in countries other than their home country are left in limbo by the current immigration polices. This is a cause of great concern. In fact the New Zealand immigration process takes less time than the Canadian process with no confusion over point system (whether current or retroactive).

The current proccessing times really affects the Canadian Government's ability to attract genuinely qualified workers causing a lot of frustration among applicants from the United States.

Your thoughts and comments on the above subject matter would be highly appreciated.

   Submission of a complete and clear application is th best means of ensuring that your case is processed as quickly as is possible. However, given present processing backlogs in the USA, it is not likely that your application would be concluded as quickly as you have stated would be necessary. Written communications would not help, and may delay the case.

If you have a Canadian job offer, you can pursue an employment authorization which can be concluded by the date you refer to above.

   Hi ,

I agree with you one hundred percent. It is a funny system; I and my wife applied for Canadian GC when we were both working in the USA and since then we got laid off and had to return to India. We got the interview call in Detroit but we were refused US visas by the US consultate in Chennai. The Canadian model of giving preference to family immigration is so stupid. Even if Iam a cobbler but my brother is a canaidan GC I qualify but as a well qualified engineer with masters degree I get called for an interview and even transfer of files are not looked favourably. Iam so frustrated !! I wish I had applied for New Zealand in NZ u get bonus points if u have a family member but will not form a basis for immigration.

I dont know how many more H1 workers have been affected on this accord. I have also submitted all my papers in metticulous order but now it has drawn a flak. Please email me at talliguy@indiatimes.com if u are also facing the same problem.

   I agree, Canadian immigration process has been a nightmare lately. I wish I had never planned for it ... It was better to apply for NZ as it was giving away the GC in less than 6 months at that time.

On the contrary, if you still have a job in US you can get a US GC faster than Canadian GC!!! As my case got delayed by 18 months just becuase they could not verify my employer's name (due to company merger) and I am still waiting. I regret applying for the Canadian GC.
