   Sir

First I would like to congratulate you on maintaining the finest website catering to canadian immigration services. Also please answer my following query.

I applied for immigration from buffalo consulate in Oct 2001, Subsequently I came back to India and I have worked here for a year since then. I am presently planning to go back for further education to United states. will the fact that im a fulltime student effect my immigration application. As I have full intent to establish in canada.

Kindly advise what is required from me and implications on my applications if any

   You have the right to apply as a skilled worker even if you are a student, and this will not negatively affect your application. However, if you have already applied and you are changing your status from full-time worker to student then you need to write to the Consulate and inform them of this matter. Your letter should state the following:
- Your name and file number
- The reason for your letter (i.e. change of employment status)
- Your work experience since the time of your application (i.e. one year spent in India working)
- The name of the educational institution you are now attending and the degree you are pursuing

It is in your best interest to maintain the same intended occupation that you stated in your IMM-8, and I suggest you state in your letter that this intended occupation has not changed.

Along with the letter you should also include the following proof: - an original letter of reference from your employer in India for the past year (please note that the employer may be contacted for verification purposes by CIC) - a notarized copy of your US student visa - an original letter from the educational institution you are attending attesting to the fact that you are registered there as a full-time student.

Please note that if you do not wish to make your employer in India aware of your intention to move to Canada you can ask that a trusted colleague write a letter of reference for you, as long as it is on company letterhead. If it is not on company letterhead then the statement needs to be sworn in front of a notary or solicitor. Also, you may ask in your letter that they not contact your employer.

   Thank you so much for your expert and invaluable advice.
I have just received my assessment, which states I require
an interview & my application is in queue to be transferred.
I don’t want to take any chances with my application now
Hence I have decided to continue working fulltime in India
In my intended occupation. Do I still require to write to the Consulate and inform them of this matter or the same can be done at the interview stage?

   There would be no need to advise the visa office prior to the interview in such a case.
