"Fiance in Mexico"
 
   I am a Canadian Permanent Resident with along distance relationship with a Mexican national.. During the past year I have been to Mexico twice and she has been to Toronto...we communicate daily either by phone or e-mail and plan to marry at our earliest convenience in Toronto during the early summer. I have been led to believe she can enter Canada as a visitor, get married in a civil ceremony, she would then return to Mexico to complete a one year employment contact that expires in Jan 003...I cannot sponsor her as family class as I was forced into bankruptcy in Sept 002. As a proffessional she has a PHd in communications and a Ba in journalism...multi=lingual in French, English and Spanish....scores 91 points......Anyway, what is to stop her from arriving in Toronto next Jan entering as a visitor, as she is my legal spouse, and applying for inland processing on Humanitarian grounds for permanent residence...she is financially secure, and I have no debt,with an income of $60,000 a year....she is in excellent health...albeit 3 months pregnant I would be grateful for any responses, as I have had conflicting information from Immigration on this matter

   It does not appear that any grounds for an inland application presently exist as she is neither a spouse or common-law partner. If, however, she did visit Canada and you married at that time, then an inland application would likely be permitted.

If married to a Canadian and within Canada, then an application for sponsorship may be submitted within Canada, as the marriage would constitute sufficient Humanitarian and Compassionate grounds to allow for such. Such an inland application is processed entirely within Canada, unlike a standard sponsorship which is generally concluded overseas.

In such a case, the temporary status of the applicant will generally be extended for the duration of the application process. Also, once an approval in principle is obtained, an open employment authorization may be obtained.

An undischarged bankruptcy would prevent sponsorship. If that was the case in your situation, then it may be necessary for your spouse to look into the possibility of a Skilled Worker application for immigration to Canada.
