Under the new regulations, current applicants who submitted their applications before December 15, 2001, and receive an interview, or interview waiver before June 28, 2002, will be processed under the old regulations.Applicants who submitted their applications before December 15, 2001, and do NOT receive an interview, or interview waiver before June 28, 2002, will be processed under the new regulations, and be expected to achieve a point total of 75.
Applications submitted after December 15, 2001, will be processed entirely under the new regulations, and be expected to achieve a point total of 80.
It should be noted that the new regulations may allow immigration officers to utilize positive discretion, and award an applicant with a landing document, even if an applicant does not meet the required point total. Use of positive discretion however will likely require that the applicant demonstrate some aspect of his/her potential to excel within Canada.
