"183 Day Rule and Bill C-11"
 
   According to Section 28 of Bill C-11 a permanent resident complies with the residency obligation with respect to a five-year period if, on each of a total of at least 730 days in that five-year period, they are physically present in Canada.

The section does not mention anything about 183 Day Rule.
Will 183 Day Rule still apply if the new Bill C-11 is implemented?

   At present, it appears that the 183 Day Rule will be eliminated. There is no mention of such in either the proposed Act or Regulations.

On February 9th 2002, a second "tranche" of the Regulations will be published, which could specify similar provisions. If not, however, then the 2 of 5 year provisions would replace the 183 Day Rule entirely.
