"A declaration signed in Romania is valid in Quebec?"
 
   Very briefly, I would like to inform you that more than 1 year ago I decided to emigrate to Quebec. Therefore I sent the preliminary application in October 2000. At that time I was single but I got married in June this year to a 31 yrs. old woman with an 11 yrs. old child from a previous marriage.

Unfortunately our marriage has serious problems and we decided to separate. In just a few words, I found out she was using me as a "passport" for arriving in Canada.

We passed the interview held in Bucharest a few days ago but at this moment I don't want to take her to Canada with me unless I can have legal guarantees that she won't try to get the maximum benefits there, during the divorce. At this moment I don't trust her at all. I know that according to the Canadians laws she could get an important percentage from my salary after the divorce and I really don't want this to happen.

She says she is willing to declare officially (in front of a Notary) that she doesn't need/want anything from me after the divorce will be pronounced in Quebec. The only problem is that I don't know whether this declaration made in Romania is valid in front of Quebec's justice for the purpose of divorce.

Could you please inform me if I can use this declaration in order to protect my future incomes in Quebec? Or, is there any other legal possibility to do so before leaving from Romania?

   This is not an issue which is governed by the Immigration Act or Regulations. You should consult with an attorney specialized in Family Matters. You may contact the Canadian Bar Association for references to such lawyers.
