"183days Rule, how often?"
 
   Dear Sir,

Our Immigrant Visas have been approved and we are planning to leave by March 2002. After about a month upon landing my husband will be back to our country of origin to avail the 183 days rule and continue work, all because of our worries that it is now recession in Canada. My kids and I will be left on our own there with some friends and relative around.

Now, how many times it is possible to avail the 183days rule out of canada. He is planning to come back Canada before that expires and fly to our country again to continue working until at least finish his contract by year 2003 doing this procedure.

Is there a better and safe way to achieve this plans of ours? Does the Immigration Officer would doubt his intentions for coming in for a month then going out of Canada on several ocassions? Although of course he does not abandoned Canada because of our ties there.

   There is no limitation as to the number of times that an applicant may avail himself of the 183 Day Rule.

You should note, however, that the 183 days are counted within any given 12 month period, and not necessarily from the date of departure. Residing in Canada for less than 183 days out of any given period of 12 months would mean that the applicant may be deemed to have abandoned Canada as the place of permanent residence.
