"Landing Questions: Important"

My friend has a following situation,

* Got landing papers by mail from Buffalo consulate.
* US work visa & I-94 has expired. An extension petition
is pending with INS. This petition may/may not be approved
depending on how INS views the attorneys paperwork.

Question:
+++++++++
1) Can one enter Canada for Landing purpose without valid
US visa ? Should one go to home country for vacation and enter
back from there ? Which is preferable.

2) Can one enter back to US with candian PR and commonwealth
passport ? How quickly can one enter back ? Can I just enter
Canada, stay a few days and enter back US without a Visa?
Do I need to wait for some Card by mail, sign a lease for appt..
or anything else to show residency in Canada ?

3) What duration can one stay in US in this manner ?

4) Does entire family must enter Canada on same day for landing?
Can Spouse/Child come in later ? How much time later ? Does one
need to do some paperwork to bring family in stages into Canada?

As long as you have not misrepresented yourself in your application for immigration to Canada, the status that you hold is not a factor at the time of landing. We recently had a client who landed successfully despite having overstayed in the USA. Although the Canadian immigration official verified that the information about his initial entry to the USA was provided accurately at submission, his landing was not otherwise barred.

Subsequent re-entry to the USA, and eligibility to remain there, is a matter that is subject to US immigration laws and policy. Although a permanent resident of Canada holding the passport of a Commonwealth nation may appear at a US port of entry without a passport visa, this does not necessarily mean that the US immigration official is obliged to admit the individual.

Accompanying dependents may land at any time with or following the principal applicant, as long as that is within the validity of the landing documents.
