Hi,

My wife and I decided to ignore the law that a resident should reside in Canada while the spouse sponsorship case in under process. Although we applied 13 months ago, my wife got landed 20 months ago (sept 2010) and during the last 20 months I've only seen her 3 times. So our patience is over!
I was wondering if anyone of u knows what would be the consequence if the officer understand that she is living with me in Iran. Roll Eyes

i know it's hard but u should follow their rules....u don't want the officer to b suspicious of her not living in Ca anymore....there could b a number of ways: tax returns, the lost of the health benefits (6 months outside Ca), they can contact her work and see that she resigned / quit, the place where she used to live (will she change her address too?; if not who will take care of her mail in case she gets something from CIC?), stamps in her passport?? (maybe they don't put although i heard that they started to put for the PRs)....they have their ways if they really want to check Sad Roll Eyes of course like it happenned in Wardeh's case nothing happpenned at the end but it's a risk...can't she just visit u without quitting her job, cancelling the apt lease etc (like an unpaid leave)??

note: we have this discussion just cuz ur wife is a PR (for citizens there r no such requirements)

Hi Siavash,
You will probably get your passport  request from Ankara in the next couple of months. I don't think her being outside Canada for only a couple of months would be a problem. She would probably stay in Iran with you for 2-3 months before this whole process is over and I don't think staying outside Canada for that short period of time would cause any problem. However, in case it took any longer than that she would probably have to go back to Canada and wait for you there cuz you don't want to face any problems. Maybe you can plan a visit for like 60-90 days max and see if you get PRR in the meanwhile, which I am pretty sure you will.If not, at least you guys have been together for a few months and bearing the last days away from each other would be much easier.

yeah that's true i don't think 60-90 days would b considered not-residing in Canada anymore but noone can say for sure...maybe sohrab? Smiley but she needs to make sure she's not cancelling things back in Ca (like lease contract, she can sub-lease it for a few months) and other things...it shouldn't give the impression that she's moving out of Canada...good luck!!

They haven't made their quarterly update for the processing times yet, so it's an opportunity for anyone who's waited a full 14 months to send a case-specific inquiry to your embassy.

The sponsored person has to send the inquiry if the sponsor is a Canadian citizen, since they don't have an option for Canadian nationality.

They say it's for providing them important updates or questions about your file, so it's best if you have at least something to update them on, then you can slip in a question or make a point.

Btw, since there is no residency questionnaire form anymore how can they really find out that she is not living in Canada?

haha exactly, no there is no consequence, but no seriously if they found out they wont make a big deal out of it because the situation pretty much justifies anything

ok i got an update, as we thought, at the moment everything is up in the air,
the people who just got ppr have 2 options, contact ankara REPEATEDLY and ask for an exception or go to ankara....

As i mentioned before this was unexpected....... no one was prepared, not even CIC, the federal government chose to do it and we have no control...... money is more important than anything else to the government,
anyways from what i found out, not everyone has to travel to ankara to submit a passport, because that means they will stay and wait ..... they dont want that, so they are trying to figure out a way.... TNT  DHL  ARAMEX no longer handles passports because they were instructed by the iranian government(canadian embassy in tehran)
it will change but at the moment this is how it is

Sohrab jan thanks for your response. I have already contacted Ankara, they asked us to wait for a few more days. The lady also mentioned not to go there in person until they ask us to do so. My husband is determined to go to Ankara next week. I don't really know what we should do. I'm not sure whether they will issue the visa on the same day or they will keep his passport for a few days.....
