Hi,

I have been working in USA for more than two years now under a working visa... I am trying to apply on canada through buffalo office but I have traveled outside USA on two or three vacations during this period, so I don't have a continuous stay of one year in USA, the maximum I have without leaving on vacation is about 10 months. but during the periods I was outside USA, I was on vacations from work and I was still receiving my salary and my working visa was still valid.

so my question is: to apply through buffalo, do I need to have to live in USA for a continuous year without leaving the country even on vacations, or as long as I am legally admitted to the states for more than a year now, it is okay to apply?

You really should read the instructions.  It doesn't say stay in the US for a year.  It states ADMITTED for 1 year. If you were admitted for 1 year (not 6 months and then extended) you can apply to Buffalo as the visa office.

Thanks a lot... So as long as my USA working visa is valid for 3 years... I can apply through buffalo, right?

Last thing, where I can find these instructions? Do you have a URL I can use?
