conjugal or common law sponsorship?

need help!!! im a filipino citizen and separated for 8 years but not yet annulled because my ex-wife won't cooperate. what are my options going to canada? i have a girlfriend in manitoba, we have been together for 7 years now. all your suggestions are welcome....tia.

Unless you have lived together continuously for 1 year, you are not common law, therefore if you want to apply, you must do so as conjugal.

You don`t need your wife to cooperate just so you can get an annulment in the Philippines.  The more she will not cooperate the better it will be for you.  The public prosecutor will be investigating for `collusion` and if during the interview you were found to be in agreement with your wife your petition will be dismissed.  The common ground for annulment of marriage in the Philippines is psychological incapacity.  You need a psychologist as an expert witness in your trial.  Annulment is an expensive and very long process but it`s worth it and it`s the only way for you to marry you girlfriend.  I`m doing my annulment right now so i`m a bit of an expert  .
If you`re not going to file for an annulment then why not try the Federal Skilled Worker Category or work in Canada as a Temporary Foreign Worker with a possibility to apply as permanent resident as Provincial Nominee.

We filed for conjugal partnership now waiting for a positive result  We tried applying for tourist visa but we were denied twice maybe because of the reason that I'm a nurse, so we went through the conjugal partnership route. It's really difficult to prove way lot of paper works and proofs to show but it's worth it. And hopefully if I get to go to Canada that's where I will be filing for divorce after a year of residency there. Then we will get married in Canada.

Thank you. I really hope so too. Yes there are a lot of situation the same as ours because our government wont approve divorce in our country. We didn't live together either that's why we opted for conjugal partnership because it says that u can't live together for a lot of reasons one of which is that we don't have divorce in our country, it's also for same sex, and if you both tried living in each other's country but there are a lot of barriers. We have been together as a couple for more than a year now and he visited me twice and I met his dad and step mom cus his step mom is also a Filipina and they met my family too. I really hope that my application will go smoothly because I've really been depressed myself too my birthday is coming up and he's not with me. Last year he was here to spend my birthday with me and we went to Boracay. Now that my birthday is coming up I'm missing him more and it's just frustrating that all our plans are put on hold and we are counting on someone to play God and dictate about how our life will be. Whether we'll be together or not.
