Author Topic: Confused about which country can I send my spouse sponsorship application.  (Read 451 times)

Dear all,

I am currently an International student in Canada and I married my canadian husband just a couple months ago and we are working on the spouse sponsored application process.

We have been preparing and reading the materials about spousal immigration application and have called the the Visa office in Canada a couple times and we end up having a confused location to send our application kit to.

Some of the advisors on phone have said that it is okay for me to choose which country to send my application to(we were planning to send it to buffalo New York as it would be easier to arrange the interview location) but some of them said that I can only send my application back to my home country.
Since different Canadian Visa office can have a big difference in Processing times , I am wondering if any one can explain the actual process of application to become a PR through spouse sponsorship.

Further details about my case are:
1. I am an international Student who was born in China but have been living in Hong Kong since birth. So I am actually a Hong Kong Citizen.
2. My husband is a Canadian Citizen.
3. I have been an international student in Canada for 1 year and half now and will continue my study in Canada for the next 2 years.
4. My husband and I have been living together since I first came to Canada, so before our marriage , we were kind of like in a cohabitation 
    relationship.( With no house or cars sharing tho, only joint accounts)
5. I am planning to do an application from outside of Canada because the in-Canada processing time is very long.

are you legally allowed in the USA for at least 1 year so do you have a Visa for USA if you need 1 to enter USA if you do not choose the country where u legally have access to

yes i do have a visitor Visa to USA that is valid for the next 9 years. But I don't quite understand is that how will that make a difference about if i can send my application to USA or not.

You can choose Buffalo as your visa processing office regardless of what country you from but incase an interview is requested, you will be require a US Visa.

Note: You must send your complete application to the Mississauga for the first stage approval after which they will forward it themself to the visa office you have selected on your application which is for instance.

If you were admitted to Canada with a visa that was good for a year or more, you can apply through Buffalo. Just make sure you will be able to get into the USA for the interview, if necessary - you say you have a valid US visa, so you should be OK.

Not sure you'll have the choice:

"The application for permanent residence for members of this class no longer gives applicants a
choice as to which office will process their applications. CPC-Mississauga, which receives the
applications, will make this determination pursuant to R11 and will forward the file to the
appropriate visa office. The option of selecting the office where the sponsor wanted the
application to be processed has been deleted from the "application for sponsorship and
undertaking."

That's from the Aug. 18, 2011 iteration of their overseas processing manual #1.

So what you would need to do is be SURE that you include, with your application, a copy of your valid Canadian temporary status document.  I'd also throw in your USA visa, too.  That should prompt CPC-Mississauga to route your application to Buffalo rather than to Hong Kong.

Married 9'06, ap sent 3'07 & refused in 1'08 due to inadmissible son.  Won appeal 1'10.  Back in process 4'10, new meds req 5'10 - submitted in June.  New FBI submitted 8'10  Approved 30Nov2010! COPR recd 05Jan2011. LANDED 31Jan2011 YAY!
