Hi everyone,

Just out of interest.. if someone sends a common-law sponsorship application in for processing but then breaks up with their Canadian common-law partner while it is processing and moves out, does that mean they cannot continue with the application even if the ex-partner is willing to sponsor them?

Continuing with the application after the relationship has broken up would constitute fraud. So the short answer is that you cannot legally continue with the application.

That relationship would now fall under Section 4 (1) - it is not genuine and it is for the purpose of gaining status under IRPA.
