My husband got arrested for selling alcohol to a minor while working in a gas station in US. He found guilty and got the Class B Misdemeanor. This was about a year ago. We are F1 student here and both are eligible to become principal applicant. Do you think we should apply with his criminal record? and who should be the principal applicant?

It is a minor offence and your husband has already served the sentence. If he is good enough to stay in US why should Canadian authorities have a problem with his stay in Canada? Either of you may apply as the PA.

If both are equally eligible on PA.....then suggest you to be PA....but make sure you declare this history in the application and provide proof that he has completed the sentence...
