Nothing is easy.
Situation: I am married to a Chinese woman who has a daughter from a previous marriage
. I am a Canadian citizen. We have not yet applied for PR. My Chinese step-daughter is 17 and wishes to attend university in Canada, in my city this Fall. Would wish to come attend ESL classes in the summer. She has >90 average and already has been conditionally accepted at one university here and granted a significant multi-year scholarship. Based on this, she will apply for a study permit soon. I will be her Custodian (up to age 19 in my province). Soon after she turns 18 this May, we then intend to apply for my wife's PR. Daughter is single and a dependent. Acceptance for my wife's PR is > 7 months according to the CIC website for Beijing, if no problems.
Questions:
1) What can we do to show CIC that, yes, the daughter really is coming to study and would return to China after 4 years (assuming the PR is unsuccessful and "dual intent" is allowable) ? Her mother works in China, they have family, home, some money etc. But I am the new step-father, live here, and it will be obvious that we wish to eventually be together. Of course by the rules.
2) What are realistic thoughts on the success of this ? We would really be relying on the dual intent provision i.e. Study Permit/TRV does not preclude also applying for PR (as I understand it). Of course, I really wish it, but can start to see the problem areas (me, as family living in Canada being the major one). Is there anything else we could do so she can study here? Have others been through a similar situation?
3) I am also considering have my Chinese wife apply for a TRV to accompany her daughter (should she be approved) to Canada, and stay for a 2 week visit. This is reasonable isn't it ? - daughter has not traveled outside China before. My wife would then need to return to her job as she is taking vacation leave, and still has all her assets, other family and responsibilities in China. Also, the PR could not then be granted. This TRV application (and the Study Permit application which would be done first) will all be made before the PR application. Sounds like a TRV application AFTER a PR application for a spouse would not be worth trying at all. But is it worth us trying my wife's TRV before the PR as I describe?
