Hi every1  Smiley and Khilafah5
I received another letter Dated 16 June 2012,(this letter is posted 2 months and 10 days after AOR), requesting 2 things,
"Proof of your sponsor's income, adequate financial arrangements for  your care and support in Canada: i.e your sponsor's recent notices of assessment (2009-2011), T4's Employment letter(s), recent pay stubs, your bank statement, your sponsor's bank statement, and documentary proof of any other financial support available to you in Canada"
"Statement of live birth for your daughter"
Now i have 2 questions
1.Do i have to send them everything my self or my wife can send these documents directly to CHC-I from Canada?
2. My wife has been working off and on in last 3 years, she hardly wen't to work for 6 months in this period, moreover she was in Pakistan for around 17 months in the mention time (2009-2011). She started a proper Job in March 2012 when my daughter turned 8 months old. Is that gonna be an issue if i don't make up things(like Tax papers), and tell them everything as it happened?

Salam i just want to u guyz to tell me what will i do in dat situation b4 i didnt getting the medical appointment b4 4 july becuz dey issue me dat medical on 4 june so i mail dem and asked for extension and dey gave me of one month extension now suddenly i get the oppointment of 30 june b4 from 4 july now how can i tell dem? I heard dat bar bar email karna sa acha impact nhi parta is dat true?

I am in a similar situation, I have sponsored my husband. I am living with my husband currently but we are debating if I should go back to Canada. Some say its risky, others keep saying its not a problem since I am a citizen.

It doesn't matter whether ur a citizen or pr holder u shud be in canada while processing is being done...it's not a healthy sign of staying here with ur husband..it can delay ur case..n it's for sure it goes into negative impact on ur case..rest ur choice if u want to delay or get out of this v soon..

Just do ur medical n send them the receipt..no need of telling them again n again coz they rnt interested in knowing it..its ur case n u shud be knowing how to get out of It ASAP..so just do ur med n send them the receipt..n dun email them again n again....not a gud sign..

You are a Canadian citizen so there is no problem... bcoz citizens are considered as tourist when outside Canada. Stay here... no need to tell them you are here.. but no problem if they find out.

wHY WILL IT BE REJECTED? I was under the impression that citizens can livw qith their spouses outside canada while the application is being processsed?

last week a memers case was rejected because "THE SPOUSE WAS NOT RESIDING IN CANADA)

this is what was wriiten on the letter he got

Your sponsor, who is a Canadian citizen, currently does not reside in Canada and I am not satisfied, based on the information provided on your application and your response that she will reside in Canada should you be granted permanent residency. Your sponsor does not, therefore, meet the requirements of subsection 130(2) of the Regulations and as a result, you do not meet the requirements of section 120 of the IRPR.
Section 41(a) of the IRPA states that a person is inadmissible for failing to comply with this Act in the case of a foreign national, through an act or
omission which contravenes, directly or indirectly, a provision of this Act; and
Subsection 11(1) of the Act provides that a foreign national must, before entering Canada, apply to an officer for a visa or any other document required by the regulations. The visa or document shall be issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act. Subsection 2(1) specifies that unless otherwise indicated, references in the Act to "this Act" include regulations made under it. For the reasons set out above, I am not satisfied that you meet the requirements of the Act. I am therefore refusing your application.

heres the reason another member from pakistan got rejected because hes wife was living there for a long time

ur taking a big risk if u leave canada for a long time

Hey Khilafah,

why can't wife be with husband during sponsorship?? my sister was with her husband after marriage and applied for sponsorship from Pakistan, she did recently come back and is planning to go back to Pakistan...is this going to be a problem?

Also...I just saw your updated list you posted...you updated mine with "forms + reppc" for me...are you just assuming or you have some insider info? Wink

I told them either to speed up my case or allow my wife to come back to Pakistan, until i get the visa.
My daughter was born in Canada last year and my wife was just on her own, with a very little social circle, as her parents moved back to Pakistan back in 1985. so there is actually no one to be with my wife, moreover winters are hard down there
So i just notified CIC and called her back, I actually called her back and then notified them.  Wink

Thought I'd watch this from sidelines but debate not ending Smiley...maybe this would help:

Sponsor

    130. (1) Subject to subsections (2) and (3), a sponsor, for the purpose of sponsoring a foreign national who makes an application for a permanent resident visa as a member of the family class or an application to remain in Canada as a member of the spouse or common-law partner in Canada class under subsection 13(1) of the Act, must be a Canadian citizen or permanent resident who

        (a) is at least 18 years of age;

        (b) resides in Canada; and

        (c) has filed a sponsorship application in respect of a member of the family class or the spouse or common-law partner in Canada class in accordance with section 10.
    Marginal note:Sponsor not residing in Canada

    (2) A sponsor who is a Canadian citizen and does not reside in Canada may sponsor a foreign national who makes an application referred to in subsection (1) and is the sponsor's spouse, common-law partner, conjugal partner or dependent child who has no dependent children, if the sponsor will reside in Canada when the foreign national becomes a permanent resident.

Coming from some angle of expertise...for sure this is an additional complication however if one can show clear ties to Canada, there shouldn't be any trouble...ties such as a job to get back to, family in Canada and future plans in Canada. You can show through communication that the couple were having a hard time apart and after much consideration decided upon this. But I think it would be key to show you will come back to Canada immediately after your spouse becoming a PR and more importantly have something to get back to such a job and family or your house in Canada etc. Also remember you must be able to support your spouse so if no job when back...how will you survive? Remember under the context of Canadian culture maybe its not normal to say our family will support us.
