You definitely have to declare her in your 2011 Tax return, even when she is not living with you ! Second include a translated copy of Nikah Nama with the Tax Return, otherwise they will ask you for it. (Include a covering letter mentioning that your spouse is not yet PR of Canada).

Guys, I still have not filed my taxes... I have a question.... if you got married in 2011 but your wife is not living with you (she's not even PR yet).. what do you put when filing?

I'm in the same boot I got married in Feb, 2011. yesterday I file my taxes and my accountant ask me about my status I told him I'm married now and he mention in my 2011 Tax paper he said doesn't matter where your wife leaves. We have to info revenue Canada. And he ask me her date of birth , full name.

I think it's good idea atles we have this proof to show Immigration our relationship is genuine.

A lot of you are talking about filing taxes and if you should let Revenue Canada know about your marriage or not.

My opinion on this issue:

Do it as soon as possible. Add your foreign spouse on your tax return. They will ask you to state your spouses total income for 2011 in Canadian dollars and submit a copy of your marriage certificate. So you should send a copy of translation of your Nikkah nama and a copy of your original Nikkah nama. Its better if you have transferred some money to your spouse in Pakistan. This way you can prove that your spouse is dependent on you.

Huge Benefit:

If you include your spouse in your tax return, you will get a lot more return if your spouse isn't working abroad or working but has very little income in CAD. Talk to your accountant and work out the scenarios. Last year I included my spouse in my tax return and I got back a big chunk of the Fed & Provincial tax portion back.

By adding a dependent to you tax return i.e. your spouse, your indepedent income will then change to "family Income" and thus you will get a break on your taxes. You don't need to show anything from your spouse if your spouse doesn't work in Pakistan. If you transferred some money to your spouse, its even better to prove that you support your spouse and he/she is dependent on you. Whatever his/her income is for the year 2011 in CAD you will then add it to your family income. In almost all the cases, the refund gets bigger. My wife doesn't work in Pakistan, If i was to file the tax by myself and didn't add her I wasn't getting anything back but by adding her as my dependent spouse, i got back a huge portion of FED and Prov tax that I paid during the year

Hi Forum members - Does any one have the same situation as I... My husband was called on Feb 22 for few questions by CHC, the agent said to my husband that he will get a letter in the mail within one week but still nothing.. checking on e-case the status was changed to in process with a comment that 'we started processing your case on Feb 29'.. I send an e-mail wondering why still haven't received this letter as it may be timed .. and the e-mail response was 'we have mailed out a request on March 7th'

I wish there were better people working in CHC Islamabad...they just don't have it togeather.. I have no idea if this letter was send via regular mail or TCS service...and what if they want the documents in certain time fram like... please provide us with so on and so within 10 or 15 days .. Any of you are facing similar situation ..My husband's file was transferred December 23 2011.

Any suggestions on what I need to do... I am so anxious ..

I am in the exact same situation as you. They replied to my email on March 12th that they sent my wife a letter on Feb 18th but we didn't receive the letter yet. Its almost a month now since they sent the letter. They didn't say if they sent the letter by regular mail or TCS. You should wait for a week and see if you get anything in the mail. If you don't get anything, then email them and ask them to send it again by TCS and you will pay the charges.

Anyways, if you all are talking about taxes, then i got married last year so when i did my taxes yesterday for the first time since ive been married and i got a huge chunk back. Im really happy about it. whatever you have earned at your job, for the first $10,500 there will be no tax and the amount will be returned to you because of your status (Married).

Yes you will need to send a copy of your nikah nama (English+Urdu). I also had money transfer receipts to prove that i have been sending money back home to my wife.

I got married in 2010 and when i filled my taxes for 2011, I had to state that I am married and write a letter to them explaining the date of marriage, where you go married and where your wife is. i.e a non resident. It's not wise to hide the fact your legal marital status has changed.

Further to the tax filing conversation.. when I got married in Jan 2011 I sent CRA a letter informing them of the marriage and explaning the situation. So this is technically the first year I am filing as "married".  Would I send my Nikka Nama with the tax return? and also my husband works so do I just convert that into dollars when I state his income? How would this work?
