Results for speaking truth!! I applied for my wife sponsorship and after 6 months left Canada. Now we are living in South Africa, We have resident visa stamped on our passport. CHC has asked for Re imm forms, PCC and copies of my passport, proof of in income and residence in Canada. If I will hide this, they will put me in more trouble. What will happen if i tell them truth tell them what they will do ? We do have plan to come back after her approval but to get this approval we have to hide a lot and if get caught results are denial Share your feed back! I would recommend you should move back to CANADA. You should remember CIC Rejects many cases when they find that sponsor doesnt have ties to CANADA. Its very serious issue. PLUS not telling them truth is also not gud. |

Hi Ifftikhar!
The reason sponsorship was rejected was that I was married to somebody else in canada (but was separated from 2 years, going to file the divorce) at the time of marriage in Pakistan, actually I went to Pakistan on the funeral of my Dad but due to some serious family issues I had to marry, when I came back somebody told me if my intention was not to get married there then may be i can sponsor, or get sponsorship after got rejected and appeal.
So the sponsorship got rejected but her Permanent resident application was in Islamabad, and now status on cic is "the decision has been made on your application, the office will contact you concerning this decision.
My question is that how long they will take to contact? they will contact sponsor? or sponsored person? or they will send back the file? if yess then to whom? me or my wife?

Zawaar according to Canadian Immigration law you cant married if you are already married as you said you divorced case was filed at the time of your marriage mean you were still married at that time of your 2nd marriage you shouldnt got married and applied for sponsership till your divorced deed in your hands and if you go in Appeal they probably will also reject you because you didnt qualify according to Canadian Immigration law. According to Islam you have right to get marry even 4 but according to Canadian Law you cant have 2 wives but you could applied to your wife as a common law as you were not divorced at that time. Consult some lawyer they will give you better advise on that. |

Thanks for the nice advice. How long more do I have to wait. It has been 13 months and I haven't recieved a thing from them. I am sick and depresssssed.I feel like killing myself. I pray 24/7
just keep in mind always that husbands cases takes more longer than wives cases so then you will have patience and yes prays always works. timeline is 26months now so be aware of that to. |

Zawaar, according to Canadian Law, after you receive your divorce certificate from the court you have to wait 1 year before you can get married again and then you can sponsor right away too. But not before 1 year time period is over. This information is 100% accurate, it happen to someone in my family.
It is best you right a letter to Immigration Canada Mississauga advising them that you were mislead and did not know that you cannot get married before the court issue's a divorce certificate and that you are requesting them to assist you on how to proceed with this situation. Ask Immigration Canada to assist you first then get a lawyer. Lawyers just want to make money and really cant get anywhere with Immigration. You have to represent yourself and defend your case on your own. If you have any questions you can ask me too, take care and BEST OF LUCK. Inshallah there is a way ... the right way!
