Hi

I am a PR, did not comply the residency obligations, waiting to return, appeal filed, case in IAD, hearing date is not scheduled yet.

My wife & children got TRVs arrived Canada, filed refugee claim due to genuine fear of persecution, case in RPD, hearing date is not scheduled yet.

Can i make a request to IAD to allow my appeal on the basis of Best Interests of my children as they are in Canada, though their status is also in process?

Anyone please advice, Leon PMM especially.

1.  No likely, they have no status in Canada, you have no status.  You will have to wait for your appeal, and as well as their refugee claim.

I have a status as i am PR until negative decision is made by the IAD. I think i should try as nothing to lose.

Hello northyark
I would like to share with you my case:
I am PR did not comply with residancy obligation. a departure order issued against me only, my wife and children are still PR.
What is the best choice:
File appeal : how long i should wait for hearing ?do i keep my residancy status till IAD decision?is it possible to travel to US and come back during waiting period( i hold US Visa)?
What about if the appeal decision was negative?Am i eligable to apply for visit visa  to visit my family in Canada?
or i will be inadmissable?
Or,beter for me not to go with appeal and apply for a new rimmigration through sponsorship of my wife?

Need yor Help from all experties

Hi

Positive decision has been made by the RPD for my family and they got the status of protected persons.

My hearing in the IAD will be held in May.

LEON your input will be highly appreciated, any thoughts that might be helpful for my appeal, please.
