hello everyone

one of my friend wants to apply for immigration under FSW
but the thing is that that caps has been reached
"1122 Professional Occupations in Business Services to Management (Cap reached)"
what should he do now, does he has to apply next year.
pls advise.

Hello vishal..if he has the job offer then no problem!!!have read in CIC website..
"Once the cap has been reached, we can only accept applications for this occupation from people with an existing offer of arranged employment." so think not to worry!!!

Hi, if he doesnt have any job offer, then only option left is to wait until next year if the same NOC is available.

Actually there are 2 different ways to apply under FSW Category 2

1) Job offer with LMO - this is a labour market opinion from HRDSC, allowing you to get a temporary work permit. Basically the employer offers you the job but must first apply for LMO. In order for the LMO to be approved the employer must demonstrate that they have advertised the job for at least 2 weeks during the last 3 months within a suitable Canadian citizen or permanent resident being found for the role. If the LMO is approved you can get a TWP and start work immediately in Canada, then apply for PR from within Canada

2) AOE - this is arrangement employment offer. This also has to be approved by HRDSC, like LMO, however the diffrerence is that you apply for residency from outside of Canada and do not begin to work for the company until your PR is approved.

Since not so many companies want to wait 12+ months for people to start, most FSW2 probably go down the TWP/LMO route.

He can use the time until July next year to look for a job offer but if he can't get one and wants to apply under the CAP when it re-opens on July 1st, he should have his application ready to be send and he should send by courier.  The CAP this year was lowered to 500 applications and it filled up very fast.

Canadian Immigration policies keep changing. Currently, the cap system and the intake of application for NOC in High demand spans for a year after which, again based on the requirement of Canada, the # of intake, NOC would change in July of 2012.

The Ministerial List of NOC's might change in 2012 and NOC 1122 might or might not be in the list. People anticipate for their NOC's to be in the list and thus prepare beforehand and mail them ASAP so that their application is counted in the CAP.

Right, the CAPs are reset every year on July 1st and at that point, they may change the list of NOC's allowed or raise or lower the CAPs.  Last July 1st, they lowered the CAPs from 1000 per occupation to 500.

Nobody knows what they will do next year but you must be prepared to apply because if you wait until July 1st and then only start working on your application, you risk your CAP getting full before you can apply because a lot of other people were already prepared and waiting.
