As time is going out and filling up the CAP gradually, so CIO should inform completeness applicants about their current position.
However, if any application returns, then s/he has a chance to reapply with in a shortest possible time.
After eligiblity review, they can send AOR.
Otherwise, thousands of applicants are in dark without any information as CIC has changed rules from 26 June and losing their chance to reapply in the same year. If possible some one, let them (CIO) know about the situation of post 25 June applicants.

Thnx. some one should give them (CIO) suggestion to give an email atleast to the applicatants. Sometimes they review the system process later on, like CIC updating the completeness number from 19 October 2010 in website, very funny!

Total complete applications received since June 26, 2010

On June 26, 2010, the eligibility criteria for Federal Skilled Worker applicants changed.

Between June 26, 2010, and June 30, 2011, a maximum of 20,000 complete Federal Skilled Worker applications will be considered for processing. Within the 20,000 cap, a maximum of 1,000 Federal Skilled Worker applications per eligible occupation will be considered for processing within this same time frame.

These limits do not apply to applications with an offer of arranged employment (job offer).

As CIC posted the completeness applications from 19 Oct to 9 Nov' 2010, now total completeness applications number is 3,531 (though mistakenly posted in cic website is total number 3,532). So, in last 21 days CIO received and completed average 62.14 applications per day. If this happen in coming days, CIO will receive and complete the completeness number of applications 14,479 (62.14 X 233 days-remain) more number of applications up to 30 June 2011. In that case, only NOC 1122, 2121, 3113, 3131, & 3152 will fill the maximum limit of CAP 1,000. So, number of applications will be reduced and ultimately total completeness number of applications will be 12,335 as on 30 June, 2011 and rest number 20,000-12,335 = 7,665 will not be filled up. You can say 38% of total target will not fill-up in this year (26 June 2010 to 31 June 2011).

What an effects of new category and CAP, which CIC has introduced to reduce the number of applications under FSW1. Have any comments!

On 26 June 2010, CIC has introduced CAP of 20,000 under FSW1. If we may consider, the number 20,000 will be the target of 2010-11 for permanent immigrants under FSW1, basically it does not mean the number of total permanent immigrants has been reduced from target 250,000 (actually in between 250,000 to 265,000) per year. Last year permanent residents number (as principal applicant) was 40,735 including Arranged Employment Offer (AEO)-FSW2.

The different number of category in 2009 was - family class 65,200, economic immigrants 153,498 (including FSW1), refugees 22,846, other immigrants 10,635.
Total number of Permanent Residents (PR) was 252,179. Here you see, only 16.15% (40,735) of total PR (252,179) was for Principal applicants (excluding spouse & dependents) of FSW1 & FSW2 in 2009.

Ultimately, less than 50% has been reduced from last year experience (in 2009) for Federal Skilled Workers Category-FSW1 and open number for FSW2 in 2010-2011.

What is meant by a cap? Does that limit refer to the total number of applications received or the total number of applications processed, or the total number of applications that are successful?

The cap is a limit on the number of complete applications considered for processing. In this case, Citizenship and Immigration Canada will only consider a maximum of 20,000 complete applications under the occupation list. There is no limit to the number of applicants with a job offer.  Within the 20,000 cap, a maximum of 1,000 federal skilled worker applications per occupation will be considered for processing each year.

June 28, 2010Ministerial Instructions and Federal Skilled Worker Class Applications


Purpose/Issue
On June 18, 2008, the Immigration and Refugee Protection Act was amended to give the Minister of Citizenship and Immigration authority to issue instructions that would ensure the processing of applications and requests be conducted in a manner that, in the opinion of the Minister, will best support the attainment of immigration goals set by the Government of Canada.

The first set of Ministerial Instructions (MI) was issued on November 28, 2008. The second set of MIs, issued on June 26, 2010, introduced a number of changes, including a revised list of eligible occupations, annual limits to the number of applications to be processed in the Federal Skilled Worker (FSW) class, as well as revised eligibility criteria with respect to evidence of official language proficiency and work experience. The second set of MIs also includes instructions for the federal Immigrant Investor Program and the Canadian Experience Class that will be addressed in separate operational bulletins (OB). Overview of MIs – June 26, 2010
The second set of MIs applies only to applications received by the Centralized Intake Office (CIO) on or after June 26, 2010. It does not apply to any application received before June 26, 2010. All complete FSW applications received by the CIO on a date prior to the Canada Gazette publication date shall continue to be considered for processing having regard to the first set of MIs.

FSW applications received by the CIO on or after June 26, 2010, accompanied by the results of the principal applicant's English or French language proficiency assessment [ Note 1 ], not exceeding the identified caps and that meet either of the following criteria shall be placed into processing:

Applications from skilled workers with evidence of experience in the last ten years under one or more [ Note 2 ] of the National Occupation Classification (NOC) codes specified in the MIs up to a maximum of 20,000 new, complete applications per year with no more than 1,000 applications of this maximum in any one NOC category;
or

Applications submitted with an Arranged Employment Offer (AEO) consistent with requirements of subsection R82(2) of the Immigration and Refugee Protection Regulations (IRPR).
Note: As of June 26, 2010, the stream for temporary foreign workers and international students living in Canada for one year no longer exists. Students and temporary foreign workers applying in the FSW class on or after June 26, 2010, must meet the criteria of the second set of MIs in order to be eligible for processing.

Limit on the number of applications to be processed per year
A maximum of 20,000 FSW applications, without an AEO, will be considered for processing each year.

Within the 20,000 cap, a maximum of 1,000 FSW applications per NOC code will be considered for processing each year.

In calculating the caps, applications will be considered in order of the date they are received. Applications received on the same date will be considered for processing having regard to routine office procedures.

For the unique purpose of calculating the caps, the first year will begin on June 26, 2010, and end on June 30, 2011. Subsequent years will be calculated from July 1st to June 30th, unless otherwise indicated in a future MI.

Guidelines for new and existing applications
All FSW applications will be considered in order of the date they are received.

FSW applications received at the CIO before June 26, 2010
The second set of MIs does not apply to complete applications received prior to June 26, 2010. All FSW applications received by the CIO on a date prior to the Canada Gazette publication date shall continue to be considered for processing having regard to the first set of MIs.

FSW applications received at the CIO on or after June 26, 2010
The second set of MIs applies to cases received at the CIO on or after June 26, 2010. The CIO will assess complete applications received on or after June 26, 2010, against the MIs to determine whether applicants are eligible for processing. Those determined to be eligible will be placed into processing. Applications that receive a negative determination of eligibility will not be processed and will receive a full refund.

Submitting the application
All FSW applications will continue to be sent to the CIO. Applicants are required to submit their complete application, together with all supporting documents, to the CIO. This includes all documents listed both on the CIO and visa-office-specific document checklists. Official language test results from a designated language testing agency must be submitted with the application.

The CIO will review applications for completeness pursuant to section 10 of the IRPR. If the application received is incomplete, the entire application package will be returned to the applicant.

Final eligibility determination at the CIO
The CIO will assess the applicant's submission as-is and make a final determination of eligibility. To be eligible for processing, the applicant must meet all the criteria described in the MIs. If the application is eligible for processing, the applicant will be informed and the entire application will be forwarded to the visa office requested. Once processing has begun at a visa office, the cost recovery fee is no longer refundable.

If the applicant's submission is determined to be ineligible for processing, the applicant will be informed and will receive a refund.

cos i completed the 1st stage 2nd is not going thru
